263 Stanton his then booker and that since that time he hath not received any part or parcell thereof nor any Satisfaction or Security for the Same to the best of his Knowledge Sworn before me this 18.th day of december 1734 Ed Rownd A Copy of the foregoing declaration and account were made and Sent to be Served on the defend.t with the writt in the plea afd according to act of assembly in such Case made and provided Att which said third tuesday of march to witt the Eighteenth day of the Same month anno Dom one thousand Seven hundred and thirty four Came the said Robert Bolten by his attorney afd and the sheriff of Somerset County to whom the foregoing writt was directed Likewise Cometh & maketh return thereof to the Court here Endorsed in these words Following Viz.t Cepi Corpus declaration delivered in time p Jos MClester sher Whereupon the said Donnock Dennis in his Own proper person Cometh and defendeth the force and Injury when &a and saith that he Cannot gainsay the action afd of the afd Robert Bolten nor Can he Say but that he did assume upon himselfe in manner and form as the afd Robert Bolten above against him hath Complained and as to the damage of the Same Robert by him by Occasion of the premisses in that part Sustained the Same Donnock saith and Confesseth that the afd Robert hath Sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his Suit in that part apposed to three pounds two Shillings and One penny Curr.t money of maryland and not more and because the afd Robert denys not this but the Same allegation Confesseth to be true prays Judgmt for those damages above Confessed together with his Costs and Charges aforesaid to him ^to be^ adjudged &a Therefore by Consent of the parties afd it is Considered that the afd Robert Bolton recover agt the afd Donnock Dennis his damages afd to the afd three pounds two shillings and One penny Currt 262 money of maryland in form afd Confessed as also Two hundred & Sixty Two pounds of tobacco for his Costs and Charges to the Same Robert by the Court here and Consent of the parties afd Adjudged and the afd defendent in mercy &a
Answer unto Joseph Caldwell of a plea of trespass upon the Case &a and that thereof he should not fail &a And the afd Joshua Caldwell by George Douglas his attorney Complained against the said Thomas Holbrook in the plea afd as Followeth viz.t Somerset County ss Thomas Holbrook late of Somerset County planter was attached to answer unto Joshua Caldwell of a plea of trespass upon the Case &a And whereupon the said Joshua by George Douglas his attorney Complaines that whereas the said Thomas on the first day of January anno Dom One thousand Seven hundred and thirty three at |
