Somerset to be held at dividing Creek the third Tuesday of November then next to answer unto John Rider of a plea that he render unto him six pounds Current money and two hundred and Ninty three pounds of tobacco which to him he oweth and unjustly detaineth &a And that thereof he should not fail &.a Att which said third Tuesday of November to witt the ninteenth day of the same month ann Dom one thousand seven hundred and thirty four being the day of the return of the said writt cometh the said John Rider by William Beckingham his attorney and the Sheriff of Somerset County to whom the foregoing writt was directed likewise Comes and makes return thereof to the Court here Endorsed Cepi Corpus p Joseph Macclester Sher Whereupon the said Thomas Baker present herein Court in his proper person at the prayer of the said John Rider by his attorney af.d is adjudged to give special bail to the action af.d Thereupon a Certain Day Scott of Somerset County Gentleman came hereinto Court in his proper person and ^did^ undertake and assumed upon himself for the said Thomas Baker (likewise the said Thomas Baker present as af.d assumed upon himself) that if in Case the said John Rider should recover Judgment against the said Thomas Baker in the plea af.d or that the said Thomas Baker should be therein Convict that then he the said Thomas Baker shall pay the Condemnation of the Court thereupon or render his body in Execution of such Judgment to the prison of the Sheriff of Somerset County in satisfaction thereof or that he the said Day Scott will do the same for him &.a And Thomas Baker in his own proper person Cometh and defendeth the force and Injury when &a and Saith that he Cannot Gainsay the action afd of the abovesaid John Rider nor but that he Oweth the the same John the afd Six pounds Currant money and two hundred and ninty three pounds of tobacco manner and |
