Wherefore for that your Petitioner is now remediless by the rules of Comon Law and
only releavable in a Court of Equity your Petitioner most humbly prays that
that the said Patrick Burke may true and perfect answer make whether he did
not deal with your petioner to what value or whether he Ever paid your petitioner
any sum or sums of money or and upon what Account and how and generally
Answer all and singular the premises as if again particularly Interrogated and
that your Worships will make such order and decree therein as shall be agreeable
to Equity                            And your Petitioner will pray

    And the aforesaid Patrick Burke by Francis Allen his attorney Cometh and defendeth the force &
Injury when &a and prays Leave thereof to Imparle here unto the bill afd untill next Court
and he hath it and the same day is Given to the afd James here also &a

       Att which said next Court to witt the nineteenth day of Novem Anno Dom One thousand
seven hundred and thirty four Came againe as well the afd James Lindow by William Beckingham
his attorney as the afd Patrick Burke by Francis Allen his attorney and the Bill afd
being read and heard and fully understood and Mature deliberation thereupon had &a

          Wherefore it is Considered by the Justices here that the afd Patrick Burk pay unto the
said James Lindow three shillings Current money &a  Also it is Considered that the afd Patrick
Burke recover against the said James Lindow Two hundred
200   pounds of tobacco to the same Patrick by discretion of the Justices here at his request for his
Costs and Charges in that part sustained according to act of assembly in Such Case made & provided
adjudged &a


        To the worshipfull Court of Somerset County these Gent whereas we the Subscribers were
appointed by the worships to Vew a Certain road at y.e Indian River which was
required to be turned by David Hazards and wee have according to order
been on y.e s.d road and do find that the said road may be turned without doing
Either travellor or neighbour any harm or prejudice & therefore have ordered
y.e s.d David Hazard to Clear and Gubb y.e s.d Road and it shall be good
returned under our hands this 19.th day of October 1734               Jno Smith
