(240) Court brought may appear) and being so thereof Indebted the day and year af.d at the place aforesaid in Consideration thereof upon himself did assume and to the said Thomas then and there did faithfully promise that he the said Henry the aforesaid three pounds Ninteen shillings and six pence unto the said Thomas when he should be thereunto afterward requested he would well and faithfully pay and Content Nevertheless the aforesaid Henry his promise and assumption aforesaid in form aforesaid made little regarding but plotting and fraudulently Intending the aforesaid three pounds Ninteen Shillings & six pence or any part thereof to the said Thomas hath not paid or any wise Contented altho' the same Henry afterwards (Viz.t) the day and year aforesaid and often afterwards at the County aforesaid by the said Thomas was thereunto requested but the same to him to pay or Content hitherto hath refused and still doth refuse and deny wherefore the said Thomas saith he is the worse and hath damage to the value of seven pounds Current money as aforesaid and thereupon he brings Suit &.a pledges &.a John Doe & R Roe
June y.e 18.th 1734 Then came before me y.e subscriber one of his Lordships the Lord proprietarys Justices of y.e peace for the County of somerset Tho.s Gardner and made Oath on the holy Evangelist of almighty God that he hath not rec.d directly or Indirectly received any part or parcell of y.e above acc.t or any ^thing in^ security or satisfaction thereof to the best of his knowledge Whereupon the said Henry Tomlinson at the prayer of the afd Thomas Gardner by his attorney afd is adjudged to give Speciall bail to the action aforesaid &a Thereupon a Certain William Catlin of Somerset County planter present here in Court in his proper person undertook and assumed upon himselfe for the said Henry Tomlinson Likewise the said Henry Tomlinson present here in Court in his proper person assumed upon himselfe that if in Case the said Thomas Gardner should recover Judgm.t against him the said Henry Tomlinson in the plea afd or that he should be therein Convict that that then he the said Henry Tomlinson shall pay the Condemnation of the Court thereupon or render his body in Execution of such Judgment to the prison of the Sheriff of Somerset County in Satisfaction thereof or that he the said William Catlin will do the same for him &a And the af.d Henry Tomlinson by George Douglas his attorney Comes and defends (the |
