(23) Mary is Admrx of all and singular the Goods and Chattles Rights and Credits that were of Nicholas Murphey deced of a plea that he Render unto them four pounds Eight Shill.s Lawfull of money of America which from them he Unjustly Detained &c.a And Whence the said Rob.t and Mary by Thomas Bluett their Attorney Complain that when the said Edw.d the Twenty sixth day of May in the year of our Lord one thousand seven hundred and seventeen at Somerset County aforesaid and within the Jurr of this Court by his Certain wrighting obligatory sealed with the seal of him the said Edw.d and to the Court now here to be shown whose date is the day and year aforesaid acknowledged himself to be held and firmly bound unto the aforesd Nicholas in his LIfetime in the said four pounds Eight Shillings to be paid to the Said Nicholas when afterwards he should be thereto required Nevertheless the said Edwd altho often thereto Required Nevertheless the Said Edw.d Altho Often thereto Required &.c the said four pounds Eight shillings to the said Nicholas in his Lifetime or to the said Robt or Mary after the Death of the said Nicholas hath not paid but the same to the said Nicholas in his LIfetime and to the said Robt and Mary after the Death of the said Nicholas to pay hath altogether Refused and to the said Robt and Mary hitherto Refuses and Unjustly Detains to the Damage of the said Rob.t and Mary Ten pounds Currt Mony and thence they bring suit &ca and offer here in Court the aforesaid Letters of administrators &c pledges do pros Jno Doe & Richd Roe Whereupon the said Edward Clufe being Called appears and thereupon the said Edward Cluffe at the prayer of the afd Robert Boardman by his attorney afd is adjudged to give speciall bail to the action afd thereupon a Certain John Stewart of Somerset County Merchant present herein Court assumed upon himselfe and undertook for the said Edward Cluffe that if in Case the Said Robert Boardman should Recover Judgmt in the plea afd against the said Edward Cluffe or that the said Edward Cluffe should be there in Convict that then he the said Edward Cluffe should pay the Condemnation of the Court thereupon or Render his body to the Custody of the sheriffe of Somerset County in Satisfaction thereof or that he the said John Stewart will do the same for him and thereupon the said Edward Cluffe prays that the afd Robert Boardman may give Security for Costs in Case nonsuite be obtained against him in the plea afd which is by the Court here granted thereupon Thomas Bluett of Somerset County Gent present here in Court in his proper person undertakes for the said Robert Boardman that in Case he be nonsuited in the plea afd or Otherwise Legally Cast that then he the said Robert Boardman shall pay the Condemnation of the Court thereupon and all Costs accrewing unto the said Edward Cluffe or that he the said Thomas Bluett will do the same for him &c Thereupon the said Edward Cluffe by Francis Allen his attorney afd Comes and defends the force and Injury when &c and prays Leave thereof to Imparle here untill Next Court and he hath ^it^ and the same day is Given to the afd Robert Boardman and Mary his wife here also &c Att which said next Court to witt the Twentieth Day of June Anno Dom one thousand seven hundred and thirty two Came again as well the aforesd Robt and Mary as the Aforesaid (Edwd) |
