(232) that you have the Same before our Justices of our County Court of Somerset to be held at dividing Creek the third Tuesday of November next then and there to be Condemned according to act of assembly to and for the use of a Certain Jonathan Sturgis Unless the said Joseph Gabey by himself or his attorney shall and appear and answer unto the said Jonathan Sturgis &.a according to law and that by good and Lawfull men of your bailywick you make known unto the person or persons in whose hands you make the same attachment that he she or they be and appear before our Justices of our County Court to be held as af.d to shew Cause if any he she or they have why the same goods Chattles Rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made (according to act of assembly in Such Case made and provided) if to him her or them it shall seem meet and how you shall Execute this writt that you make known unto our said Justices at the day and place af.d and have you then and there this writt Wittness Robert King Gent Chief Justice of our said Court the twenty third day of august In the twentieth year of our dominion &.a Ann Dom One thousand Seven hundred and thirty four Att which said third Tuesday of November to witt the Ninteenth day of the same month Ann Dom one thousand seven hundred and thirty four being the day of the return of the said Writt Cometh the said Jonathan Sturgis in his proper person and the Sheriff of Somerset County to whom the foregoing writt was directed likewise Comes and makes return thereof to the Court here Endorsed I Certifie that by vertue of the within writt I have attached on the first day of November in the year within mentioned at Somerset County the Sum of three pounds three Shillings and four pence in the hands of John Driggeress of the goods and Chattles Rights & Creditts of the within named Joseph Gabey and at the same time and place made known unto him that he should be and appear at the place within Contained to Shew Cause as is likewise within directed if to him it should seem meet before Edmond Hough and John Doe good & lawfull men of my bailywick so answers Jos Macclester sher Whereupon the said John Driggress Garnishee of the afd Joseph Gabey altho' Solemnly Called Cometh not but makes default nor shews Cause why &a Thereupon the said Jonathan Sturges in his proper person prayeth that upon Giving Security according to act of assembly in Such Case made and provided the afd Sum of three pounds three shillings and four pence Curr.t money so as afd attached may be Condemned in the hands of the said John Driggress as of the rights and Creditts of the Said Joseph Gabey towards satisfying unto the said Jonathan Sturges his damages and all Costs and Charges accrewing by means of the attachment afd &a thereupon |
