228 value of Eight pounds Six Shillings & Eleven pence Current money of Maryland) by pretext whereof & also by force of the Statute in that case made and provided the af.d John Britt and Thomas Bellings became Chargeable to pay to the said Heritt Ratchford the af.d sum of seven pounds Eleven Shillings and nine pence of the value af.d according to the tenor of the said note and being so thereof Chargeable the af.d John Britt & Thomas Belling on Consideration thereof afterward to wit on the third day of June Ann Dom seventeen hun hundred & thirty three at the County af.d upon themselves did assume and to the said Heritt Ratchford then and there faithfully promise to pay to the said Heritt the af.d sum of money of the value af.d according to the tenor of the said note and altho the af.d John and Thomas have paid to the said Heritt the sum of two pounds seven shillings and Eight pence half penny Current money of virginia of the value of two pounds twelve shillings & five pence half penny Current money of Maryland part of the said seven pounds Eleven Shillings & nine pence Current money of Virginia Nevertheless as to five pounds four shillings and a half penny Current money of virginia of the value of five pounds fourteen shillings and five pence half penny Current money of Maryland Residue of the s.d seven pounds Eleven Shillings & nine pence Current money of virgenia the af.d John Britt & Thomas Belling their promise and assumption af.d in manner and form af.d made little regarding but minding and fraudulently Intending the af.d Heritt in that part cratfily and subtily to deceive and defraud the af.d five pounds four shillings and five pence half penny Current money of Maryland & residue of the said seven pounds Eleven shillings & nine pence Current money of virginia to the s.d Heritt at four months after the date of the said note did not pay altho the same to doe by the said Heritt afterwards Viz.t on the thirtieth day of November in the year last mentioned at the County af.d the said John and Thomas were required but the same to him to pay have altogether refused and still doe refuse to the damage of the said Heritt Ratchford Eleven pounds Current money of Maryland and thereof he brings Suit &a pledges &a John Doe & Ric.d Roe A Copy of the foregoing declaration was made and sent to be served on the deft with the writt in the plea af.d According to act of Assembly in such case made and provided Att which said third tuesday of November to witt the ninteenth day of the Same month anno Dom One thousand Seven hundred and thirty four Cometh the Said Heritt Ratchford by his attorney afd and the Sheriff of Somerset County to whom the foregoing writt was directed Likewise Cometh & maketh return thereof to the Court here Endorsed in these words vizt Cepi Corpora decln in time delivered p Jos MaClester sher Whereupon the said John Britt and Thomas Billin by Francis Allen their attorney Come and defend the force and Injury when &.a and pray that the afd Heritt Ratchford may give Security for Costs in Case they be nonsuited in the plea afd which is by the Court Granted thereupon a Certain John Dennis Junr of somerset County Gent present here in Court in his proper person undertakes for the said Heritt that in Case he be nonsuited in the plea afd or otherwise Legally Cost that then the said Heritt shall pay the Condemnation of |
