June Court            1733            21

One thousand Seven hundred and thirty three Came againe as well the afd James as the afd Haber by their attorneys
afd and thereupon the same Haber as before defends the force and Injury when &.c and as to forty five shillings Sterling
Charged in the account of the said James viz.t Twenty two shillings and Six pence Sterling for Liberty of the Cabin
to Liver poole and twenty two shillings and Six pence for passage and Liberty of the Cabin from Corck to Maryland
being of the Value of three pounds Currt Mony of Maryland in the said James his Account
Charged he saith that he did not assume upon himself in Manner and form as the said
James above in his Declaration aforesadi hath alledged and of this he putts himself
upon the Country &ca  And the plf.t in Like manner            and as to one pound four shills
and Eight pence half penny residue of the Debt in the said Declaration mentioned the
said Heber saith that the aforesaid James his Accon aforesaid against him the said Heber
thereupon to have and Maintain ought not because he saith that altho he the said Heber
as to the aforesaid one pound four shillings and Eight pence half penny he did assume
upon himself as the said Plft above in his Declaration alledgeth  Nevertheless the said
Heber saith that since his Assumption aforesaid so as aforesaid supposed to be made
he hath an Acc.o of his own for Sundrys properly Chargable in Acct which hath accrewed
due to the said Heber from the said James and y.t at Somerset County within the Jurrisdic.n
of this Court Ammounting to teh Sum of three pounds and six pence Currt mony of Maryland
as by account hereunto annexed May appear which he prays he may be admitted to Discount
against the Debt of the aforesaid James done by the Said Heber Amounting to one pound four
Shillings and Eight pence half penny aforesaid according to the form of the act of assembly
in that Case lately made and provided and this he is ready to Varifye wherefore the said Heber
prays Judgm.t and that the aforesaid James from having his accon aforesaid thereupon
against him the said Heber may be barred &c.a

          The above is a true Copy of the Debter side Charged to James Lindow in any  
          Book duly proved according to Act of Assembly P     Heber Whittingham

             Whereupon the Same attorney of the afd Haber Whittingham Relinquisheth his verification afd
by him above alledged and the Same attorney Says that he is not Informed by the Same Haber his Clyant
of any Answer for the Same Haber to the afd James ^in the plea af.d^ to be given and nothing Else thereof Says by which
the Same James Remaineth against the afd Haber thereof undefended &.c

       For which the Same James Lindow his damages by Occasion of the premisses against the afd Haber
