19 in Such Case made and provided whereupon the afd Edward Rownd present here in Court gave Security for ye due prosecution of a writt of Injunction according to the form following vizt Somerset ss Know all men by these presents that we Edward Rownd Joshua Caldwell and John Dennis Jun.r of Somerset County are held and firmly bound unto William Allen of Philadelphia Merch.t asignee according to the form of the act of assembly in such Case provided of Thomas Budd of the City of Philadelphia who was assignee according to the form of the act of assembly in such Case provided of Robert Atkins of the City of Philadelphia in the province of Pensilvania Marriner in the full and Just Sum of three hundred pounds Currant money of Maryland and nine hundred Sixty Six pounds of tobacco to be paid to the said William Allen his Executors adm.rs or assignes to the true payment whereof we bind our selves and Every of us our and Every of our heirs Executors and adm.rs Joyntly and Severally for and in the whole firmly by these presents sealed with our Seals and dated this 24.th day of August Ann.o Dom 1733 Whereas the above Bound Edward Rownd hath Obtained an Injunction to stay proceedings at Law on a Judgment Rendered against him in Somerset County Court by the Justices of said Court for the sum of one hundred and fifty pounds Currant Money of Maryland and four hundred and Eighty three pounds of tobacco Now The Condition of the above Obligation is such that if the said Edward Rownd shall prosecute the said writt of Injunction with effect and satisfie and pay as well the said Sum of one hundred and fifty pounds Currant money of Maryland and four hundred and Eighty three pounds of tobacco as all Costs damages and Charges that shall accrew in ye Chancery Court or be Occasioned by the delay of Execution on the said Judgm.t unless the Court of Chancery shall decree to the Contrary and Shall in all things obey such order and decree as the Chancery Court shall make in the premisses than the above Obligation to be void and of None Effect Else to be in full force and virtue Signed sealed & delivered In presence of us Ed: Rownd (seal) W.m Lane Josa Caldwell (seal) Jno Scott John Dennis Junr (seal)
the said William Horsey the twentieth day of February in the Year of Our Lord One thousand seven hundred seven hundred and thirty One at Somerset County afd was Indebted unto the Said William Wye in ten pounds five shillings Currant money of Maryland for divers goods and Merchantdizes to the said William Horsey by the said William Wye at the Speciall Instance and Request of him the said William Horsey before that time sold and delivered and being so thereof Indebted the said William Horsey in Consideration thereof afterwards to witt the day and year aforesaid at Somerset County af.d and within the Jurr of this Court upon himself did assume and to the said W.m Wye then and there faithfully promised that he the said W.m Horsey the said Tenn pounds five shillings to the said W.m Wye when he should be thereto required well and faithfully would pay and Content Nevertheless the said W.m Horsey his promise and assumption afs.d in form afs.d made no ways regarding but designing and fraudulently intending the said W.m Wye in this part to deceive and (defraud) |
