196 that he is the worse and hath damage to the value of forty four pounds money as aforesaid and thereof he bringeth Suit &.c and brings hereinto Court the writing aforesaid which the debt aforesaid in form aforesaid doth testifie &.c pledges &.c John Doe & R Roe And the afd Thomas Lambden by Robert Jenckins Henry his attorney Comes and defends the force and Injury when &.c and Says that he Cannot Gainsay the action afd ^of the afd John Peaden^ nor Can he say but that the writing obligatory afd is the deed of the Same Thomas nor but that he Owes the same John Peaden the afd forty four pounds in gold or silver money of maryland in manner and form as the afd John Peaden above against him hath declared wherefore the said plantiff prays Judgm.t for his debt afd and his damages sustained by occasion of the detaining of that same debt to him to be adjudged &c Therefore it is Considered that the afd John Peaden Recover against the afd Thomas Lambden his debt 302 afd and his damages by occasion of the detaining of the same debt to three hundred & Two pounds of tobacco to the same John of his assent by the Court here adjudged and the afd Thomas in mercy &c
oweth and unjustly Detains &.c And Whereupon the s.d Rob.t by Francis Allen his Attorney saith that whereas the s.d Edward the sixth day of may Ann Dom seventeen hundred and thirty four at the County of Somerset af.d within the Jurisdiction of this Court by his certain writing Obligatory which the s.d Robert with the seal of the said Edward signed here into Court brings the date whereof is the same day and year did acknowledge himself to be bound unto the af.d Robert in the af.d one hundred and fifty three pounds Six shillings Lawfull money of america to be Required the said one hundred an fifty three pounds Six shillings Lawfull money of America to the said Rob.t hath not rendred but the same to him hitherto to render hath denyed and still doth deny and unjustly detain to the damage of the said Robert of ninety pounds money af.d and thereupon he brings suit &.c pledges &.c John Doe & R.d Roe And the af.d Edward Rownd by William Beckingham his attorney comes and defends the force and Injury when &.c and says that he cannot gainsay the action afs.d ^of the afd Robt Bolton^ nor can he say but that the writing obligatory af.d is the deed of the same Edward nor but that he owes the same Rob.t Bolton the af.d one hundred and fifty three pounds six shillings lawfull money of America in manner and form as the af.d Robert Bolton above against him hath declared wherefore the said plantiff prays Judgm.t for his debt afd and his damages sustained by occasion of the detaining of that same debt to him to be adjudged &.c Therefore it is Considered that the af.d Robert Bolton Recover against the af.d Edward Rownd his debt afs.d and his damages by occasion of the detaining of the same debt to Two hundred 277 & Seventy Seven pounds of tobacco to the same Robert of his assent by the Court here adjudged and the af.d Edward in Mercy &.c |
