(18) One thousand seven hundred and thirty one Which being read and heard the said Edward saith that the said William his Action aforesaid thereupon against him the said Edw.d to have and Maintaine ought not because he saith that altho well and true it is that the writing obligatory aforesaid ^is the Act and Deed^ of him the said Edward Nevertheless the said Edward saith that since the passing of the writing Obligatory afs.d by him the said Edwd to the said Robt he the said Robt at Somerset County aforesaid within the Jurr of this Cort before the Tenth day of December in the Condition of the aforesaid obligation mencioned and before the Making of the assignmt aforesaid by the said Robt To the aforesaid Thos and before the Assignement made by the said Thos to the aforesd Wm vizt on the tenth day of Novembr one thousand the seal of the said Robt Signed here into Court brings whose date is the same day and year last mentioned became bound to him the Said Edwd in one hundred pounds Sterl mony of Great Brittain which is of the Value of one hundred thirty three pounds six shillings and Eight pence Lawfull money and Currt mony of Pensilvania of the Value of one hundred thirty three pounds six shills and Eight pence Currt mony of Maryland to be paid unto him the said Edward when he should be thereunto Requested with Condition to the same annexed that if a Bill of Exchange Drawn by the said Robt on John Bennett Esqr near Loyds Cofee house in London for fifty pounds sterl and payable to him the Said Edwd for which he the said Edwd did pass a bill to him the said Robt at Philadelphia for Seventy five pounds of Philadelphia Mony bearing Date the Twentyth day of June one thousand seven hundred and thirty was paid then the obligation of the said Condition to be void and of None Effect or Else to remain in full force power and Virtue in Law and the afsd Edwd in fact saith that afterwards before the day of the assignment made by the said Robt to the aforesaid Thomas and before the Day of Assignment made by the said Thos to the said William to witt on the Twenty sixth day of September Anno Dom seventeen hundred and thirty at London aforesd to witt at the County of Somstt afsd within the Jurr of this Cort the said John Bennett Esqr did refuse to pay the bill of Exchange aforesd and the Same bill of Exchange then and there in due form of Law did protest of which Non payment and protest the said Edwd on the twenty Eighth day of April Anno Dom seventeen hundred and thirty one at the County aforesaid to the said Robt gave Notice by Reason whereof the Said Obligation of him the said Robt passed to him the said Edwd became forfiet and so the said Robt before the said several assignments made became and Still is Chargable to pay to him the said Edwd on the aforesaid twenty Eighth day of April in the Year aforesaid last menconed the aforesaid one hundred pounds Sterl being of the Value of one hundred thirty three pounds six shills and Eight pence Currt & Lawfull mony (of |
