170 or render his body to the Custody of the sherriff of Somerset County in Satisfaction thereof or that he the said Joshua Caldwell will do the same for him &a Thereupon the said Burr Outerbridge by William Beckingham his attorney Comes and defends the force and Injury when &a and prays further Leave thereof to Imparle hereuntill Next Court and he hath it and the same day is Given to the afd Hannah herealso &a Att which said Next Court to Witt the Eighteenth day of June Ann Dom One thousand seven hundred and thirty four Came againe as well the afd Hannah Horsey as the afd Burr Outerbridge by their attorneys afd and Whereupon the said Burr Outerbridge as before defends the force and Injury when &a and saith that he hath not assumed upon himself in Manner and form as the afd Hannah above against him hath Complained and thereof he puts himself upon the Countrey and the afd plft in like manner And afterwards the same Hannah altho' Solemnly Called Cometh not nor is his writt and declaration against the same Burr Outerbridge further prosecuted therefore it is Considered by the Court here that the afd Hannah Horsey take nothing by her writt and declaration afd But that she and her pledges of prosecuting to witt John Doe and Richard Roe be in mercy and that the afd Burr Outerbridge goe thereof without day &a and further it is Considered that the afd Burr Outerbridge recover against 334 the afd Hannah Horsey three hundred & thirty four pounds of tob.o for his Costs and Charges by him about his defence in that part sustained to the same Burr by the Court here according to the form of the statute thereof made and provided adjudged & that the same deft have thereof Execution &a
the parish afd in the County afd within the Jurisdiction of this Court One Suit of Duroy Cloaths of the Value of Six hundred pounds of Tobacco and one Razor of the Value of six pounds of Tobacco of the Goods and Chattles of a Certain John Jackerman then and there being found then and there feloniously did steal take and bear away Contrary to the peace of the Said Lord prop.ry that now is his Good Rule and Government and Contrary to the form of the act of assembly in Such Cases Lately made and provided and the Jurors afd upon their Oath afd do further present ^that^ the Said John Evans the day and Year afd with force and Arms at the parish and County afd Within the Jurisdiction af.d One Razor of the Value of six pounds of Tobacco One pockett Bottle of the Value of three pounds of Tobacco and one Knife and fork of the Value of Six pounds of Tobacco of the proper Goods and Chattles of a Certain person Unknown then and there being found then and there feloniously did Steal take and bear away Contrary to the peace of the said Lord proprietary that now is his Good Rule and Government and against the form of the act of assembly in Such Case lately made & provided &a Test |
