assumed upon himselfe in manner and form as the afd Samuel above against him hath Complained and of
this he puts himselfe upon the Country  And the afd Samuel in Like manner

    Thereupon it is Commanded the sherriffe of Somerset County that Immediatly he should Cause to Come
    here before the Justices of his Lordships County Court of Somerset now in Court Sitting at dividing Creek
in the County afd twelve &a by whom &a and who neither &a to recognize &a because as well &a and
afterwards Immediately Came thereof the Jury &a and the Jurors of that same Jury by Joshua
Caldwell Gent sherriff of the County afd to this Impannelled being Called Came to witt Adam Spence Junr
Thomas Newbold John Roach Joseph Gray John White, Parker Selby Michael Godwin John
Webb, Robert Collier, James Smith Jonathan Bounds and Angello atkinson who ^to say the truth in the premises^ being duely
elected tryed and sworn upon their Oath did say that the said Patrick Burk did assume upon himselfe
in manner and form as the afd Samuel Riggin above against him hath Complained and assessed
the damages of the Same Samuel beyound his Costs and Charges by him about his Suit in that part
apposed to three thousand pounds of tobacco and for those Costs and Charges to One pound of
tobacco &a
                               Therefore it is Considered by the Court here that the afd Samuel Riggin recover
against the afd Patrick Burk the damages afd by the Jurors afd in form afd assessed as also
1943   Ninteen hundred & forty Three           pounds of tobacco for his Costs and Charges afd to the
same samuel by the Court here of his assent of Increase adjudged which Certain damages in the
whole do amount to                                                                              pounds of tobacco & the
afd Patrick in Mercy &a
afterwards the afd William Holland Bail of the afd Patrick Burk brings the same Patrick here
into Court and delivers him up to the sherriff of the County afd in discharge of the Bail peice afd and
prays the Court here that he may be discharged from the afd recognizance of Bail &a  thereupon the
said Sherriffe to witt Joshua Caldwell Gent present here in Court took Charge of the said Patrick Burk
accordingly and the afd William Holland bail of the afd Patrick Burk is by the Same Court here
discharged from the afd Recognizance of Bail as afd is praid &a    thereupon afterwards
Immediately Came hereinto Court a Certain John White of Somerset County planter and as undertook
for the said Patrick Burck and assumed upon himselfe that if in Case the said Patrick Burke
do not pay and Satisfie unto the afd Samuel Riggin the damages and Costs afd as by the
Judgment of the Court ^afd^ appears or Render his body to the Custody of the sherriff of the County afd
in satisfaction thereof that then he the said John White shall do the Same for him &a
