    but the afd John Bishop altho' at the same day being Solemnly Called Cometh not nor saith nothing in
barr or preclusion of the action afd of the afd Francis Allen by which the same Francis remaineth against the
afd John thereof undefended &a    Wherefore the said Francis his damages by Occasion of the premisses ag.t
the afd John Ought to recover &a   thereupon at the prayer of the afd Francis and by the Consent of the Same
Francis the Justices here according to act of assembly in Such Case made and provided assessed the damages of
the Same Francis by Occasion of the ^non performance of the^ promise and assumption afd beyond his Costs and Charges by him about
his Suit in that part apposed to Nine hundred and Seven pounds of tobacco &a

                Therefore it is Considered by the Court here that the afd Francis Allen recover against the afd
John Bishop his damages afd to the afd Nine hundred and Seven pounds of tobacco in form afd by the
267   Justices afd assessed as also Two hundred & Sixty Seven                                    pounds of tobacco
for his Costs and Charges to the Same Francis by the Court here of his assent adjudged & the afd defendt in
mercy &a

 His Lordship the right Honrble the Lord proprietary Commanded the
sherriff of Somerset County by his writt in these words following vizt
Somerset ss  Charles absolute Lord and proprietary of the provinces
of Maryland and Avalon Lord Baron of Baltemore &a  To the sher
of Somerset County Greeting we Command You that You attach any of
the Goods Chatles Rights or Creditts of Robert Holland Late of Somerset County Merch.t if they
Shall be found in Your bailywick to the Value of One hundred & three pounds fifteen Shillings and
Two pence Curr Money & two thousand pounds of Tobacco and when You have the same attached or
any part thereof the Same in Your Custody safe keep so that you have the same before Our
Justices of Our County Court of Somerset to be held at Dividing Creek the Third Tuesday of March
Next then and there to be Condemned According to Act of Assembly to and for the Use of a Certain
Robert Bolton Unless the said Robert Holland by himself or his attorney shall appear and
answer Unto the said Robert Bolton in a plea of Trespass upon ^the^ Case &a  According to Law
and that by Good and Lawfull Men of Your bailywick You Make known Unto the person
or persons in whose hands you Make the same attachment that he she or they be and
appear before Our Justices of Our County Court to be held as afd to shew Cause if any he
she or they have why the same Goods Chattles Rights or Creditts so attached In his her or
their hands Ought not to be Condemned and Execution thereof had and Made According to Act
of Assembly in Such Case made and provided if to him her or them it shall seem Meet and
how You Shall Execute this Writt that you Make known unto our said Justices att the
Day and place afd and have you then and there this Writt Wittness Robert King Gent Chief
Justices of Our Said Court the Twenty Ninth Day of November In the Ninteenth Year of
Our Dominion &a Ann Dom One thousand seven hundred and thirty three         Att which
said third Tuesday of March to Witt the Ninteenth Day of the same Month Ann
