136 for him whereupon the said WIlliam Gray by William Beckingham his attorney Cometh and defendeth the force and Injury when &a and prays Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the afd John here also &a Att which said next Court to witt the Ninteenth day of March anno Dom One thousand seven hundred and thirty three Came again as well the afd John Purnall as the afd William Gray by their attorneys afd and whereupon the Same William says that he Cannot gainsay the action afd of the afd John nor Can he Say but but that he did assume upon himselfe in manner and form as the afd John above against him hath Complained and as to the damage of the same John by him by Occasion of the premisses of the premisses in that part Sustained the Same William Saith and Confesseth that the afd John has Sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his Suit in that part apposed to Four thousand Nine hundred and Sixty nine pounds of tobacco and not more and because the afd John deny's not this but the same allegation Confesseth to be true prays Judgmt for those damages above Confessed together with his Costs and Charges afd to him to be adjudged &a Therefore by Consent of the parties afd it is Considered that the afd John Purnell Recover against the said William Gray his damages afd to Four thousand Nine hundred and Sixty nine pounds of tobacco 394 in form afd Confessed as also three hundred & Ninty four pounds of tobacco for his Costs and Charges afd to the same John by the Court here and Consent of the parties afd adjudged and the afd William in Mercy &a
unto Adam Spence Jun.r of a plea of trespass upon the Case &a and that thereof he should not fail &a And the said Adam Spence by Robert Jenckins Henry his attorney Complained against the Said Robert Townsend in the plea afd as followeth viz.t Somerset County ss Robert Townsend Late of Somerset County Joyner was attached to answer unto Adam Spence Jun.r of a plea of trespass upon the case &a And Whereupon the same Adam by Robert Jenckins Henry his Attorney Complains that whereas the aforesaid Robert Townsend the Twenty Third Day of April Ann Dom seventeen hundred and thirty one at Somerset County aforesaid and and Within the Jurisdiction of this Court was Indebted to the Said Adam in the sum of four pounds Current Money of Maryland for Plank by the same Adam unto the aforesaid Robert Townsend at the Special Instance and Request of the Said Robert Townsend before that Time there sold and Delivered (as by An Account thereof here in Court ready to be produced may Appear) and so thereof ^being^ Indebted the Said Robert Townsend in Consideration thereof (to Witt) the same Day and Year aforesaid and Within the Jurisdiction aforesaid upon himself Did Assume and to the Said Adam then and there faithfully Did promise that when afterwards he should be thereunto requested the aforesaid sum of four pounds Current Money aforesaid (he |
