1733 (13) Somerset ss Be it Remembred that upon the seventh day of June Anno Dom one thousand seven hundred and thirty three personally appeared before me the subscriber one of his Lordships Justices of the peace for the County of Somerset Thomas Hayward and Made Oath on the Holy Evangelist of Almighty God that the above Acc.t is Just and true as it stands stated and that he hath not Directly or Indirectly Received (to the best of his knowledge) any part or parcel of the above Account or Any Security or Satisfaction for the same more then Credit Given (as by the work done and Valued by John McCuddy and Angelo Atkinson as appears from under their Hands) sworn to the Day and Year abovesaid before me Jno Scott Somerset ss Forasmuch as it is made appear to me John Scott one of his Lordships Justices of the peace within the County afs.d by Thomas Hayward that a Certain Jacobus Arabia Is Justly Indebted unto him as appears by the ballance of the within acc.t And that the Said Jacobus is Runn away or Removed in a Secrett manner from his place of abode and has Carried and is about to Remove his Effects or Substance to defraud his Creditors &c.a Therefore in pursuance of an Act of Assembly in Such Case made and provided you are forthwith Required to Issue an Atachment According to the Directions of the Same Act against the Goods and Chattles Rights or Creditts of the Said Jacobus Arabia for the ballance of the within Acc.t as proved and the Incident Costs and Charges and for your so Doing this shall be your Sufficient Warr.t and Authority as Wittness my hand & seal this 7th Day of June Anno one thousand seven hundred and thirty three To Thos Hayward Cl Somrst Co.ty This Pursuant to an Act of Assembly of this Province now in force and by Virtue of the abovesaid Warrant was Issued the following attachment The Tennor thereof being ^in^ these words viz.t Somerset ss Charles absolute Lord and prop.ry of the provinces of Maryland and Avalon Lord Barron of Baltemore &c.a To the sher of Somerset County greeting we Command you that you attach any ye Goods Chattles Rights or Credits of Jacobus Arabia Late of Somerset County Joyner if they shall be found in your bailywick to the value of Eight Hundred and fifty pounds of Tob.o and When you have the same attached or any part thereof the same in your Custody safe keep so that you have the same before our Justices of our County Court of Somerset to be held at Dividing Creek the Third Tuesday of June next then and there to be Condemned according to act of assembly to and for the use of a Certain Thomas Hayward unless the said Jacobus Arabia by himself or his attorney shall appear and answer unto the said Thomas Hayward according to Law and that by Good and Lawfull men of your Balywick you make known unto the person or persons in whose hands you make the same attachment that he she or they be and appear before our Justices of our County Court to be held as aforesaid to shew Cause if any he she or they have why the same Goods Chattles Rights or Credits so attached in his her or their hands ought not to be Condemned and Execution thereof had and Made according to act of assembly in Such Case made and provided (if to him her or them it shall seem meet and how you shall Execute this writt that you make known unto our said Justices at the day and place afs.d and have you then and there this Writt Wittness Rob.t King Gent Chief Justice of our said Court ye twenty fourth day of April In the Eighteenth Year of our Dom &c.a Anno Dom one thousand seven hundred and thirty three Att which said third tuesday of June to witt the Ninteenth day of the same month Anno Dom One thousand seven hundred and thirty three being the day of the Return of the said Writt Came ye said |
