1733 (12) Court before our Justices are Rightfully acted and acknowledged ought to be duly Executed We Command you that by honest and Lawfull men of your balywick you make known unto the afs.d James Timmons and Aaron Timmons that they be and appear before our Justices of our County Court to be held at Dividing Creek the Third Tuesday of June next to shew Cause if anything for themselves they have or to say knoweth wherefore the aforesaid Joseph his Execution of the Judgment aforesaid against them according to the form of the Recovery aforesaid ought not to have if to them it shall seem Expedient and have you then and there the Names of them before whom to them you make the same known and this writt Wittness Rob.t King Gent Chief Justice of our Said Court the Twenty fourth Day of April in the Eighteenth Year of our Dom &c.a Anno Dom one thousand seven hundred and thirty three Att which said Third Tuesday of June to Witt the Nineteenth day of the same Month Anno Dom one thousand seven hundred and thirty three before the Justices of his Lordships County Court of Somerset held at Dividing Creek in the County afs.d Came the aforesaid Joseph Jones by Francis Allen his attorney and the sher of Somerset County to witt Joshua Caldwell Gent at the same day Returned that he by Virtue of the Writt afs.d to him Directed had made known unto the aforesaid James Timmons by Joshua Merrill and John Doe honest and Lawfull men of his balywick that he be and appear before his said Lordships Justices at the day and place afs.d to shew &c.a as within to him it was Commanded and the afs.d James Timmons so forewarned and at the same Day being solemnly Called Cometh not but Makes Default Therefore it is Considered that the afs.d Joseph Jones have Execution against the Same Timmons of the Debt and Damages afs.d according to the form of the Recognizance afs.d &c.a
