(127) for the Use of a Certain John Dennis Ju.r Unless the said Samuel McCall John Blackburn & John Allen by themselves or their attorneys shall appear ^and answer^ unto the said John Dennis in a plea of Trespass upon the Case &a According to Law and that by Good and Lawfull men of Your bailywick you make known unto the person or persons In whose hand you Make the same attachment that he she or they be and appear before Our Justices of Our County Court to be held as afd to shew Cause if any he she or they have why the same Goods Chattles Rights or Creditts so Attached in his her or their hands Ought not to be Condemned and Execution thereof had and Made (According to Act of Assembly in Such Case made and provided) if to him her or them It shall seem Meet & how you Shall Execute this Writt that you Make known unto Our Said Justices at the Day and place afd and have you then and there this Writt Wittness Robert King Gent Chief Justice of Our Said Court the Twenty Ninth Day of November In the Nineteenth Year of Our Dominion &a Ann Dom One thousand Seven hundred and thirty Three Att which said third Tuesday of March to Witt the Nineteenth day of the Same Month Ann Dom One thousand seven hundred and thirty Three being the Day of the return of the said Writt Cometh the said John Dennis Junr by Francis Allen ^his attorney^ afd and the sher of Somerset County to whom the foregoeing Writt was Directed Likewise Comes and Makes return thereof to the Court here Endorsed By Vertue of the Within Writt to me Directed to the Justices of Somerset County I Do Certifie that on the Second Day of March One thousand Seven hundred and thirty three I Did Attach of the Goods and Chattles of ye within Named Samuel McCall John Blackburn & John Allen Merchants to the Value of two pounds ten shillings and Six pence Currant ^money^ and five hundred pounds of Tobacco in ye hands of M.r James Martin and for the Use of M.r John Dennis Junr and I Do further Certifie that before John Doe & Richard Roe Good and Lawfull men of My Bailywick I have made known to the aforesd James Martin that he be and appear at the time and place Appointed to Answer Jso Caldwell sher Whereupon the afd James Martin Garnishe of the afd Samuel MccCall, John Blackburn and John Allen altho' Solemnly Called Comes nor Shews Cause why &a but made default Thereupon the said John Dennis Jun.r by his attorney afd prays that Upon giving security according to act of assembly in Such Case made and provided the afd sum of fifty shillings and Six pence Currant money and five hundred pounds of tobacco so as afd attached in the hands of the afd James Martin as of the Rights and Creditts of the afd Samuel McCall, John Blackburn and John Allen may be Condemned in the hands of the said James Martin towards satisfying unto him the said John Dennis his damages ^afd^ and Costs and Charges sustained by meanes of ^the^ afd Suit &a Whereupon a Certain Joshua Merrill of Somerset County Gent present herein Court in his proper person undertakes for the said John Dennis Jun.r according to act of assembly that if in Case the |
