A Copy of the foregoeing Declaration was made and sent to be served on the Deft with the
Writt in the plea afd According to Act of Assembly in Such Case made and provided

        Att which said Third tuesday of march to witt the ninteenth day of the same month anno Dom one
    thousand Seven hundred and thirty three being the day of the return of the said Writt Cometh the said
    John Houston by his attorney afd and the sher of Somerset County to whom the foregoing writt was
    directed Likewise Cometh and maketh return thereof to the Court here Endorsed in those words following
    viz.t Cepi Corpus declaration in time  p Joshua Caldwell sher

              Whereupon the said Dennis Cordogan in his own proper person appears and thereupon the said
Dennis Cordogan at the prayer of the afd John Houston by his attorney afd is adjudged to give special
bail to the action afd bur for want thereof the said Dennis Cordogan is Committed into the Custody of the
Sherriff of Somerset County there to remain &a the said sheriffe to witt Joshua Caldwell Gent by John Dennis Junr
his deputy present here in Court took Charge of the said Dennis Cordogan accordingly &a

    Whereupon the said Dennis Cordogan in his own proper person Comes and defends the force and Injury
    when &a and saith that he Cannot Gainsay the action the action afd of the afd John Houston nor Can
    he say but that the Said John Houston ought to recover against him the afd Eight hundred pounds
    of tobacco by Occasion of the breach of Covenants afd together with his Costs and Charges sustained by
    Occasion of the premisses afd  wherefore the said John Houston prays Judgm.t for the afd Eight hundred
    pounds of tobacco in form afd Confessed as also his Costs and Charges to him be adjudged &a

             Therefore by Consent of the parties afd it is Considered that the afd John Houston Junr Recover
against the afd Dennis Cordogan and Eliz.a his wife the afd Eight hundred pounds of tobacco in form
323   afd Confessed as also Three hundred and Twenty three                        pounds of tobacco for his
Costs and Charges afd to the same John by the COurt here and Consent of the parties afd adjudged & the afd deft
in mercy &a

 His Lordship the right honrble the Lord Proprietary of the province
of Maryland Commanded the sheriff of Somerset County by his writt in these
words following viz.t
                                 Somerset ss     Charles absolute Lord and proprietary 
                                                       of the provinces of maryland and avalon Lord Baron of Baltemore &a   To
    the sheriff of Somerset County Greeting we Command you that you attach any the goods Chattells rights
    or Creditts of Samuel McCall John Blackburn & John Allen Late of Somerset County Mercht.s  
    if they shall be found in Your bailywick To the Value of Two pounds ten shillings &
    Six pence Curr.t ^mony^ and five hundred pounds of Tobacco and When you have the Same attached
    or any part thereof the Same in Your Custody safe keep so that you have the Same before
    Our Justices of Our County Court of somerset to be held at Dividing Creek the third Tuesday
    of March Next then and there to be Condemned According to Act of Assembly to and
