Currant money of Maryland and five hundred and thirteen pounds of tobacco in form afd Confessed as also
113   One hundred & thirteen                 pounds of tobacco for his Costs and Charges afd to the same John
Horsey at his request by the Court here and Consent of the parties afd adjudged & the afd deft in Mercy &a

                                              Bartholomew Beynom late of somerset
County planter otherwise Called Bartholomew Baynom was sumoned
to answer unto John Ailworth of a plea that he render unto him
Six hundred & Eighty four pounds of tobacco which to him he Oweth
and Unjustly detaineth &a
And Whereupon the said John by George Douglass his attorney saith that whereas
the said Bartholomew the tenth day of November One thousand seven hundred and thirty
two at the County afd within the Jurisdiction of this Court by his Certain Writing obligatory
did acknowledge himself to be bound unto the afd John in the afd Six hundred
and Eighty four pounds of tobacco to be paid unto the afd John when he should be
thereunto Required yett the said Bartholomew tho often required the said Six hundred
and Eighty four pounds of Tobacco to the said John hath not Rendered but the same
unto him hitherto to render hath denyed & still doth deny and Unjustly detaine
whereupon the same John Saith that he is worse & hath damage to the Value of thirteen
hundred & Sixty Eight pounds of Tobacco & thereof he brings suite &a and brings
hereinto Court the Writing afd which the debt afd in form afd doth testifie whose
Date is the same Day & year afd &a                         Pledges &a Jno Doe & R Roe

          Whereupon the said Bartholomew Baynom present herein Court in his proper person
at the prayer of the afd John Ailworth by his attorney afd is adjudged to give Speciall Bail to the
action afd thereupon a Certain John Gornwell of Somerset County planter present herein Court in his
proper person undertakes for the said Bartholomew Baynom that if in Case the said John Ailworth
should recover Judgment in the plea afd against the said Bartholomew Baynom or that the said Bartholomew
shall be therein Convict that then he the said Bartholomew shall pay the Condemnation of
the Court thereupon or Render his body to the Custody of the sher of Somerset County in Satisfaction
thereof or that he the Said John Gornwell will do the Same for him &a

       Whereupon the said Bartholomew Baynom in his Own proper person Comes and defends
the force and Injury when &a and says that he Cannot Gainsay the action afd of the afd John
Ailworth Nor Can he Cannot gainsay but that the writing Obligatory afd is his deed nor
but that he Owes the same John Ailworth the afd Six hundred and Eighty four pounds of tob.o
in manner and form as the afd John above against him hath declared  wherefore the said
John prays Judgment for his debt afd and his damages Sustained by Occasion of the detaining
of the same debt &a
                                     Therefore it is Considered that the afd John Ailworth Recover
