118 Such Evidence as he knows against the said John Evans of and Concerning his Stealing One Suit of Cloaths of Dewroy Cloaths and Sundry Other goods and do not depart thence without the Leave of that Court &a
Arms at the parish afd in the County afd within the Jurisdiction of this Court one Bible of the Value of fifty pounds of Tobacco of the Goods and Chattels of John Thompson then and there being found then and there feloniously did Steal take and bear away Contrary to the Peace of the Said Lord proprietary that now is his good rule and Government and against the form of the Act of Assembly in such Case lately made and provided &a Test John Thompson, William Thompson & Sarah Thompson On the Backside of the foregoing Bill of Indictment it was Endorsed viz.t Billa Vera Samuel Wilson Foreman Thereupon afterwards to witt the ninteenth day of march Ann.o Dom One thousand seven hundred and thirty before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in and for the Same County Came the afd Joseph Harden al.s Hardy in his proper person according to a Certain Recognizance by him and securitys before acknowledged and being by the Sheriff of the County afd Led to the Barr had a hearing of the Indictment afd and says that he is not Guilty thereof and of this he putts himselfe upon the Country and William Goldsborough Gent attorney of his Lordship and who for his said Lordship in that part followeth Likewise Thereupon it is Commanded the sherriffe of Somerset County that Immediatly he Should Cause to Come here before the afd Justices twelve &a by whom &a and neither &a ^to recognize &a^ because as well &a and afterwards Immediately Came thereof the Jury &a and the Jurors of that same Jury by Joshua Caldwell Gent Sherriffe of the County afd to the Impannelled being Called Came to witt Edward Beachamp, Parker Selby, Thomas Ryley Wm Holland and John Flemming who to say the truth of and upon the premisses being Elected tryed and Sworn upon their Oath did Say that the said Joseph Harden al.s Hardy is not Guilty of the Felony afd Indictment afd Specified in manner and form as by the Indictment afd above against him supposed &a Whereupon all and singular the premisses by the court here seen heard and fully understood It is Considered by the Court here that the afd Joseph Harden al.s Handy be quiet and go thereof without day &a Whereupon it is ordered by the Court that the said Joseph Harden Give Security for) |
