1733 107 Somerset County ss Patrick Connelly late of Somerset County feltmaker Otherwise Called Patrick Conelly of the same place Hatter was Somoned to answer unto John Tunstall assignee of Hugh Porter according to the form of the act of assembly in Such Case provided of a plea that he Render unto him Sixty pounds Sterling which to him he Oweth and unjustly detained &a And whereupon the same John by George Douglas his attorney Says that Whereas the afd Patrick on the twentieth day of march anno Dom One thousand seven^teen^ hundred & twenty nine at Somerset County afd within the Jurisdiction of this Court by his Certain writing obligatory which the said John Sealed with the seal of the said Patrick herewith into Court brings whose date is the day and year afd did acknowledge himself to be held and firmly bound to the afd Hugh Porter Gent in the sum of sixty pounds sterling to be paid to the afd Hugh Porter his heirs Executors Admrs or assigns when he should be thereto required and whereas the afd Hugh afterwards viz.t on the thirty first day of July Anno Dom seventeen hundred and thirty one at Somerset County afd within the afd Jurisdiction by his Certain writing of assignment on the aforesaid writing obligatory Indorsed whose date is the day and year last likewise herewith into Court brings did assign to the said John all his right title and Intrest to the said Writing obligatory of which said assignment the afd Patrick afterwards Viz.t on the day and year last Mentioned had Notice by which action hath accrued to the sd John to require and have of the said Patrick the afd sixty pounds sterling Nevertheless the afd Patrick the afd sum of sixty pounds sterling to the said Hugh before the assignment afd or to the said John since that time hath not rendered but the same to the said Hugh before the afd assignment or to the said John since that time to render hath altogether refused and the same to the said John hitherto to render still doth deny and unjustly detain altho' the same to the said Hugh to render on the thirty first day of July Ann Dom Seventeen hundred and thirty one before the assignment afd at Somerset County afd within the afd Jurisdiction the said Patrick was required and the same to the said John to render afterwards Viz.t on the day and year last mentioned and after the assignment afd at Somerset County aforesaid within the aforesaid Jurisdiction was required Whereupon the said John says he ^is^ damnifyed Eighty pounds sterling and thereof he brings suit &a pledges &a John Doe & R Roe And the afd Patrick Conaly by William Beckingham his attorney Comes and defends the force and Injury when &a and prays an hearing of the writing Obligatory afd and he hath it in these words Know all men by these presents that wee John Videl of Somerset County Gent Joseph MaClester of the said County Gent Patrick Conely of the Same place Hatter & the Rev.d Thomas Fletcher of the same place Gent ^are held & firmly bound unto Hugh Porter of the afd County Gent^ in the full and Just Sum of Sixty pounds Sterling to be paid to him his heirs Executors adm.rs or assignes to which payment well and truely to be made and done we bind Our Selves Our heires Executors adm.rs and Joyntly and Severally firmly by these presents Sealed with Our Seals and dated this 20th |
