107 Joshua Atkinson, Robert Mitchell, John Webb, John Brittingham, John Lane, Francis Henderson John Dennis sen.r Giddion Tilman Littleton Townsend and William Mills who to say the truth of the premisses afd being Elected tryed and Sworn and after the Same Jurors were by the Court here Charged Concering their Verdict and from the Barr here to Commune together amongst themselves did Recede and afterwards to the same barr for their Verdict in that part to render did return upon which the afd John Tunstall assignee of the same Hugh Porter being Solemnly Called Cometh not nor is his writt afd against the said Thomas Fletcher further prosecuted &a Therefore it is Considered by the Court here that the afd John Tunstall assignee of the afd Hugh Porter take nothing by his writt and declaration afd but that he and his pledges of prosecuting to witt John Doe and Richard Roe be in mercy and that the afd Thomas Fletcher go thereof without day &a And further it is Considered that the afd Thomas Fletcher Recover agt 1056 the afd John Tunstall assignee as afd One thousand and Fifty Six pounds of tobacco for his Costs and Charges by him about his defence in that part Sustained to the Same Thomas by the Court here according to the form of the Statute in Such Case thereof Lately made and provided adjudged and that the Same Thomas have thereof his Execution &a
of Somerset County Greeting altho' we Lately being Willing for Certain Causes to be Certified of the Tenor of the record and process of a Certain plea of Debt which was before you in our County Court of Somerset aforesd betwixt John Tunstall assignee of Hugh Porter and Patrick Connelly which he the same John Tunstall assignee as afd from the aforesaid Patrick Connelly Demanded as it is said by Our Writt to you lately did Command that the Tenor of the record and Process of the plea aforesd with all things thereunto relating by Whatsoever Names the parties afd In the plea aforesd were Called before Our Justices of the provinicall Court under your seals Distinctly & Openly without Delay you should send and our Writ aforesd Nevertheless for Certain Causes us Now Moving the plea afd unto you we remit that in that plea with that speed which of right and According ^to^ Law ye may proceed our writ aforesd to you heretofore to the Contrary Notwithstanding Witness Levin Gale Esqr Chief Justice of Our Prov.l Court the 19th Day of October in the 19.th year of Our Dominion &a Annoq Dom 1733 which being Read and heard the said John Tunstall assignee of the said Hugh Porter by George Douglas his attorney declared against the said Patrick Connelly in the plea afd as followeth vizt Somerset |
