100 in Case that nonsuit be Obtained against him in the plea afd which is by the Court to him granted thereupon Willm Beckingham Late of Somerset County Gent present here in Court in his proper person undertakes for the said Amos Woodward that in Case he be nonsuited in the plea afd or Otherwise Legally Cast that then he the said Amos Woodward shall pay the Condemnation of the Court and all Costs accrewing thereon to the said Nathaniel Wattson or that he the said William Beckingham will do it for him &a And the afd Nathaniel Watson by Robert Jenckins Henry his attorney Comes and defends the force and Injury when &a and prays ^leave^ thereof to Imparle here untill next Court and he hath it and the Same day is Given to the afd Amos here also &a Att which said next Court to witt the twenty first day of August ann.o Dom One thousand Seven hundred and thirty three Came againe as well the afd Amos Woodward as the afd Nathaniel Watson by their attorneys afd and whereupon the same Nathaniel prays further Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given to the afd Amos here also &a Att which said Next Court to witt the twentieth day of November anno Dom One thousand Seven hundred and thirty three anno Dom One thousand Seven hundred and thirty three Came againe as well the afd Amos Woodward as the afd Nathaniel Watson by their attorneys afd and because the afd Amos did not declare against the afd Nathaniel in the plea afd nor prosecute his writt afd against the same Nathaniel &a Therefore he and his pledges of prosecuting be in mercy and the plft name pledges &a and that the afd Nathaniel go thereof without day Also it is Considered that the afd Nathaniel Watson Recover against the afd Amos Woodward his damages by Occasion of the premisses to Two hundred & Seventeen 217 pounds of tobacco to the same Nathaniel Watson by discretion of the Justices here at his request for his Costs and Charges in that part Sustained according to the form of the Statute thereof lately made and provided by the Court here adjudged &a
