1731 97 Confesseth that the afd Hugh hath Sustained damages by Occasion of the premisses further than his Costs and Charges by him about his Suit in that part Apposed to two pounds Eighteen Shillings and four pence Curr.t money of Maryland and not more and because the aforesaid Hugh denys not this but the Same allegation Confesseth to be true prays Judgmt & those damages above Confessed together with his Costs and Charges aforesaid to him adjudged &.c Therefore by Consent of the parties aforesaid it is Considered that the aforesaid Hugh Frazer Recover against the aforesaid John Bredy his damages aforesaid to two pounds Eighteen Shillings and four pence Curr.t mony by the Same John in 210 form aforesaid Confessed as also two hundred and ten pounds of tobacco for his Costs and Charges aforesaid to the Same Hugh at His Request by the Court here and Consent of the parties afd adjudged wch damages in the whole do amount to two pounds Eighteen Shillings and four pence and pounds of tobacco and the afd deft in mercy &c
dec.d in the full and Just Sum of fifteen pounds nine Shillings and Seven pence Currant mony to be paid ^unto^ the said John Kenedy Timothy Kenedy and Ann Kenedy their heirs Executors administrators or assignes to the which payment well truly to be made and Done we bind Our Selves our and Either of our heirs Ex.rs and Adm.rs for the whole and in the whole Joyntly and Severally firmly by these presents Sealed with our seal and Dated this 15.th Day of June Anno Dom 1731 The condition of the above obligation is such that wherein the Commissiary Generall hath transmitted unto this Court the Acco.t of the Estate of Timothy Kenedy dec.d wherein it is found that there is Ball due to the above said Orphans the Sum of Seven pounds fourteen Shill and Nine pence halfe penny if therefore the above said Ebenezer Handy & Thom.s Humphrys their heirs Exrs or Admrs shall and do well and truly pay or cause to be paid unto the above named John Kenedy Timothy Kenedy and Ann Kenedy the afd sum of seven pounds fourteen Shillings and Nine pence According to Act of Assembly and the dec.d will when they shall arrive at full age to Receive the Same &.c then the above obligation to be you void and of none Effect otherwise to Remain in full force and Vertue in Law &.c Sealed and Delivered Ebenezer Handy (seal) In the presence of Tho.s Humphris (seal) Jno Scott John Handy (seal) Thomas Hayward Jam.s Dashiell (seal)
