memorand.m the plft by James Shirley his attorney Sued out his Lordships writt of attachment ag.t


the deft the tenour whereof followeth in these words viz.t
    Somerset County ss  Charles absolute Lord and proprietary of the provinces of Maryland and Avalon Lord Baron of
    Baltemore &.c  To the Sher of Somerset County Greeting we Command you that You attach any the Goods and
    Chattels Rights or Creditts of Humphry Hughs Late of Somerset County planter if they Shall be found in Your
    bailywick to the value of six hundred pounds of tobacco and when you have the Same attached or any part thereof the
    Same in Your Custody Safe keep so that you have the Same before Our Justices of Our County Court of Somerset to be held
    at dividing Creek the third tuesday of march next then and there to be Condemned according to Law to and for the
    Use of a Certain Robert Warren unless the Said Humphry by himselfe or his attorney Shall appear and answer
    unto the Said Robert Warren in a plea of trespass upon the Case &.c according to Law and that by Good and Lawfull
    men of your bailywick you make known unto the person or persons in whose hands you make the same
    Attachment that he She or they be and appear before the Justices of Our County Court to be held as aforesaid to
    Shew Cause if any he She or they have why the Same Good Chattells Rights or Creditts so attached in his her hands
    or their hands Ought not to be COndemned and Execution thereof had and made according to the form of the act of
    assembly in such case made and provided it to him her or them is shall seem well and how you shall Execute     
    this Writt that you make known unto our said Justices at the day & place aforesaid and have you then and
    there this Writt Wittness Wm Planner Gent.m one of our Justices of our said Court the twenty fou^r^th day of
    Novem.r in the Sixteenth Year of our Dom &c Ann Dom one thousand seven hundred & thirty

    Att which said third tuesday of march to witt the Sixteenth day of the Same month being the day of the Return of ye
    said Writt Ann.o Dom One thousand Seven hundred and thirty Came the said Robert Warren by his attorney aforesaid
    and the Sherr of Somerset County to whom the foregoeing Writt Was directed Likewise Came and makes Return thereof
    to the Court here endorsed vizt   To the Worshipfull Justices within Mentioned & Certifie that I have attached
    in the hands of David Olford one hundred and Ninty pounds of Tobacco as of the Rights and Creditts of the within
    Named Humphry Hughs and further I Certifie that by Charles Rackliffe & Isaac Marshall Good and
    Lawfull men of my Bailywick I have made known unto the said David Olford that he be and apper at
    that time and place within Contained to Shew &.c as by the within preceipt I am Commanded
                                                                                                                                     John Purnall Sher

                      Whereupon the afd Robert Warren by his attorney prays that the afd Sum of one hundred and
    ninty pounds of tobacco so as aforesaid attached in the hands of the aforesaid David Olford as of the
    Rights and Creditts of the Said Humphry Hughs may be Condemned in the hands of the Said David Olford towards
    Satisfying unto the Said Robert Warren his damages and Costs and al Costs accrewing upon the writt of
    attachment afd    Whereupon the afd David Olford altho' Solemnly Called Comes not but makes default &c
   
                        Therefore it is Considered by the Court here that the aforesaid Sum of One hundred and ninty
    pounds of tobacco so as aforesaid attached be Condemned in the hands of the aforesaid David Olford as of
    the rights and Creditts of the Said Humphry Hughs towards Satisfying unto the Said Humphry Hughs
    his damages and Costs and Costs accrewing upon the writt of attachment afd and that the afd Humphry have thereof
    his execution against the Said David Olford according to act of assembly &a

This being an action of trespass upon the Case &.a  wherein the Sher of Somerset County to whom
the writt in the Same action was directed Comes and makes Return thereof to the Court here
endorsed viz.t  Cepi Corpus P John Purnall she
                                        Whereupon the Said Donnock Dennis Jun.r appears and prays that the Said John Sneed may
             Give Security for Costs in Case nonsuite be Obtained against him in the plea aforesaid which is by the Court
             Granted thereupon Levin Gale of Somerset County Esq.r present herein Court in his proper person
