54 a point of Land opposite to a Beaver dam which said Point of Land is about one hundred yards below a high turning point of Land on Richardsons side and further ye s.d Bishop says that that might ye Jury was he lay at Charles Richardson and he asked ye s.d Richardson why he did not come over to see the Jury he answered that he did not care ot goe over because he knew there would be Jangling about it for says he to tell ye truth ye s.d Line begin at S Slash whose ye Said W.m Richardson shewed M.r Perry and further saith not Also ye same day Came Dunnock Dennis Senr an Evidence aged about sixty two years and being sworn on the holy Evangelist of almighty god Saith that he to ye Best of his knowledge about sixty twenty four years past he was Sherriff and sumoned ye aboves.d Jury to the best of his knowledge ye af.d Jury did Mark a Line tree at ye s.d point of Land yt ye abovesaid Bishop declared to and further saith not The same day also Richard Tull Def.t and for Evidences came Rob.t Richardson son of Charles Richardson deceased aged about twenty five years and being sworn on ye holy Evangelist of Almighty god saith that his Father Charles Richardson told him that at that point ^of^ high Land were the said Quinton Bratton and Thomas Purnall agreed and did fix up a Ceedar post that there stood a Line tree of his Land and that Cap.t Shewell Cut it down for a Shaft to his Mill and further Saith not Also Charles RIchardson an Evidence aged about twenty four years being son to ye af.d Charles and being sworn on ye holy Evangelist of allmighty god saith that on ye af.d point of high Land where ye Cedar post stands right against a Beavour dam his father Charles Richardson told him that there stood a line tree of his Land and further saith not The same day Jos Scofield Def.t pleaded that he had another Evidences vizt John Teague who was very Mutch Indisposed and not able to come to give his Evidences therefore on the twenty third day of ye s.d Month of December came John Teague An Evidence aged about seventy years and being sworn on the holy Evangelist of Allmighty god saith that by the North side of ye Greatest beavour Dam below the high Point of Land on Richardson side and about twenty one paces up ye dams from where John Bishop said ye Jury Marked a tree ye Deponant saith that about twenty odd years past there was a Jury ^called by James Bratton & ye said deponant was then summoned as an evidence to the Jury and says that the Jury^ Markt a tree there in order to run ye lines for Bratton from thence and M.r W.m Whittington was then present & run the Line from thence ye s.d Deponant was about to buy that Land of Brattons before Bratton bought it and found it so narrow that he did not Care to pchase it and further saith that aboute one hundred yards higher up ye dames his Master Richardson told him that ye old line run from there with a line of Marked trees up to the head to a Marked Hiccory and that his son W.m Richardson told him he knew ye s.d line to be his and further saith not that his Master Richardson told him that ye North side of that great Beaver dam on ye bank or point of Land 21 paces above where Bishop declard to there they might feed his hogs for that was his Land ye s.d Deponent further Saith y.t at ye uper old line above mentioned being about one hundred yards above ye Great Beaver dam he Could see ye Cedars on ye South side ye Creek and his Master Robert Richardson and his son William both told him that their land came from those Ceeders to ye point above ye old Beaver dam it being above one hundred yards above ye s.d Beaver dam and further saith not Also W.m Porter ye same day came as an Evidence aged forty two and being sworn on the Holy Evangelist of Almighty god saith that about twenty three years agon there was Jury held as he remembrs in order to settle a bounder between James Bratton and Smith and that at that point on ye North side of ye dam where Bishop and Dennis Dammed to that there or thereabouts they Settled a Bound.r for their beginning of ye Line and further saith not Also Will.m Whittington an Evidence aged about forty seven and being sworn on ye holy Evangelist of Allmighty god saith that where ye above said Jury settled ye Bounds that the wife of old Robert Richardson who was ye owner of Mount Ephraim y.t she told this deponent y.t her husband told her as he remembrs that there or there a way there line did run and that he was desired to set his Compass where the said Jury settled and to run ye Courses of the patent from there and according he did ye s.d Richardsons wife gave ye above words in Evidence to the said Jury and the said Deponent also run from a tree at the head of the Land which s.d tree Robert Perry told them was the End of the Line run from where ye Jury settled but reversing ye Courses of the Patent for ^from^ y.t tree it came down thro' James Brattons Plantation and Houses upon which ye Jury Concluded that the Line should begin to run from where ye s.d Richardson wife gave Evidence to and further saith not As Wittness our hands this seventh day of March Ann.o Dom.r 1730/1 Jam.s Rownd Jam.s Martin
