Samuel Gillett of the County aforesaid in the Relation to the bounds of a tract of Land lying in the County ^afd^ containing two hundred acres called Kings Land we therefore require you or any three or two of you at some time and place as to you or any three or two of you Shall Seem convenient you meet on the afd Land Called Kings Land (you first having taken your oath on the holy evanglist of Almighty God according to act of assembly in such case made and provided) and there Cause to come before you or any three or two of you all Such evidences as Shall be to you or any three or two of you nominated by the Said Complainant (or deft if any) and that you or any three or two of you Examine them upon their Corporall Oaths to be by you or any three or two of you Administred on the holy Evangelist of Almighty God in the presents of the Corplainent (or Def.t if any) touhing the truth or remembrance of their knowledge or any thing that may relate to the Cause af.d and that reduceing the Severall depositions into Writing You Send the Same together with this Our Commission under Your or any three or two of your hands to us to Our County Court of Sumerset with all Convenant Speed Wittness Sam.ll Hopkins Gent.m Chiefe Justice of our Said Co.t the 22 day of August in the 16.th Year of Our Dominion &.c Anno Dom 1730 to the Foregoeing Commission it was thus answered viz.t Somerset County ss Depositions of wittnesses taken upon the Land Called Kings Land in ye County aforesaid the 12.th day of September anno Dom 1730 before us the Subscribers Commissioners appointed by the worshipfull ^the^ Justices of Somerset County Court to Examine Wittnesses concerning ye bounds of the afd Land as follows viz.t John Gillett Sen.r of Somerset County planter aged Sixty two Years or thereabouts being by us sworn upon the holy Evangelist of almighty God deposeth and Saith that about thirty Eight Years agoe he was told by the Alexanders (which was then Owners of the aforesaid Kings Land) that the red oak now in his view was the first bounder of Francis Alexanders Land now belonging to Samuel Gillett and the Second bounder of James Alexanders and that the aforesaid red oak is markt with Sixteen notches and Standing by the Side of a Small branch and this deponant further Saith that the Second bounder of the afd Francis Alexanders was a white Oak and that it stood near the north west Corner of a Small parcell of Cleared Ground about fifteen or twenty yards northwest from a Small Gum Sapling which we then Caused to be Sliped on four Sides and further Saith not his John A Gillett marke The above deposition was taken before us ye Subscribers being first duely qualified according to Law ye day and year above written John Scott, William Lane |
