39 and whereupon the same James Lindow prays further Leave thereof to Imparle here untill the next Court and he hath it and the same day is Given to the aforesaid plft here also &.c Att which Said next Court to witt the eighteenth day of august anno Dom One thousand Seven hundred and thirty Came again as well the aforesaid James Edwards as the aforesaid James Lindow by their attorneys aforesaid And whereupon the Same the James Lindow prays further Leave ^thereof^ to Imparle here untill the next Court and he hath it and the Same day is Given to the plft here also &c Att which said next Court to witt the Seventeenth day of November anno Dom One thousand Seven hundred & thirty Came again as well the aforesaid James Edwards as the aforesaid James Lindow by their attorneys aforesaid and whereupon the Said James Lindow as before defends the force and Injury when &.c and Saith that he did not assume upon himselfe in manner and form as the aforesaid James Edwards above against him hath Complained and of this he putts himselfe upon the Country and the plft in like manner Thereupon Command is given to the Sherr of Somerset County that Immediately he Cause to come here twelve &.c by whom &.c who niether &.c to recognize &.c because as well &.c of which Said preceipt the said Sherr to witt John Purnall Gent now hereat this day to witt the same day and Year Last mentioned makes Return that he hath here ready twelve &.c as by this Said preceipt he was Commanded And now hereafterwards to witt the same day and Year come as well the aforesaid plft as the aforesaid deft by their attorneys aforesaid and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt Patrick Lackey, Edmond Hough, James Martin Archibald Sterling, John Stewart, John Webb, John Donnelson, Thomas Billings, John Davis, Peter Claywell, Joseph MccClester, John Hooffington who being duely Elected tryed and Sworn to Say the truth in the premisses upon their Oath do Say that the aforesaid James Lindow did assume upon himselfe in manner and form as the aforesaid James Edwards above against him hath Complained and assessed the damages of the Same James Edwards by Occasion of the non performance of the promise and assumption aforesaid further than his Costs and Charges by him about his Suit in that part apposed to twelve pounds Eleven Shillings and Seven pence Curr.t mony of mary and for those Costs and Charges to tenn pounds of tobacco Therefore it is Considered that the aforesaid James Edwards Recover against the aforesaid James Lindow the damages aforesaid by the Jurors aforesaid in form afd assessed as also as also seven hundred and Six pounds of tobacco to the Same James Edwards at his request for his Costs and Charges afd by the Court here of Increase adjudged which certain damages in the whole do amount to twelve pounds Eleven Shillings and Seven pence Currant mony of maryland and Seven hundred and Sixteen pounds of tobacco and ye aforesaid James Lindow in mercy &c
James after the first day of march Ann.o Dom One thousand Seven hundred and five to witt on the Sixteenth day of December Seventeen hundred and twenty Seven at Somrset County within the Jur of this Co.t did make his Certain Note in Wrighting Called a Promissory Note with his proper hand Subscribed being bearing date the Same day and Year last mentioned And the Note af.d to the af.d William Cornwallis in his Life time then and there did deliver by which Said Note the Said James did promisse to pay to the Said William Cornwallis or order the Sum of Six pounds and three Shillings on Demand value reced and by reason (thereof) |
