hath Complained and assessed the damage of the said John Stewart by occasion of the non performance of the promise and
assumption aforesaid beyond his Costs and Charges by him about his Suit in that part apposed to sixteen pounds seventeen
Shillings and ten pence Currant mony and for those Costs and Charges to one pound of tobacco

                   Therefore it is Considered that the aforesaid John Stewart Recover against the aforesaid Mathew Dogan his
damages afd to Sixteen pounds Seventeen Shillings and ten pence Curr.t mony & one pound of tobacco by the Jurors aforesaid in
form aforesaid assessed as also one thousand and thirty Nine pounds of tobacco for his Costs & Charges aforesaid to the same
John by the Court here of his assent of Increas adjudged which Certain damages in the whole do amount to sixteen pd.s
Seventeen Shillings and ten pence Curr.t mony & one thousand & forty pounds of tobacco & ye afd deft in mercy &.c

          Whereupon the Aforesaid Levin Gale & James Shirley Speciall bail of the afd Mathew Dogan prays that
for to Save themselves from the afd Recognizance of Bail so as aforesaid Entered into that the Said Mathew Dogan may
be Committed into the Custody of the Sher of Somerset County thereto remain untill &c      whereupon the afd Mathew
Dogan present herein Court is Committed into this Custody of the Sher of Somerset County thereto remain untill the
aforesaid John of his damages afd Should be fully satisfied   the Said Sher by John Dennis Junr his deputy present herein
court took Charge of the Said Mathew Dogan accordingly &c

                                                               And whereupon the Said James Edwards by Francis Allen his attorney Complaines that whereas
the Said James Lindow the thirtieth day of September anno Dom One thousand Seven^teen^ hundred & twenty eight at Somerset County aforesd
within the Jurisdiction of this Co.t was Indebted unto the Said James Edwards in fifteen pounds tenn Shillings Currt
Money of Maryland for Service and Labour by the Said James Edwards for the Said James Lindow at the Speciall
Instance and request of the Said James Lindow on bord the brigantine Monokin Whereof he the Said James
Lindow was Master before that time there done & Pformed as by Acct thereof hereunto Annexed may in Court
appear and being so thereof Indebted the Said James Lindow afterwards to witt the thirtieth day of Septembr
in the year aforsaid at Somrset County af.d within the Jur af.d in Consideration thereof upon him Selfe did
assume and to the Said James Edwards then & there did faithfully promise that he the Said James Lindow
the af.d fifteen pounds tenn Shillings money af.d to the Said James Edwards when he Should be thereunto
requested well and faithfully he would pay and Content and altho the Said James Lindow two pounds
Eighteen Shillings and five pence pall of the af.d fifteen pounds tenn Shillings to the said James Edwd
Edwards the hath paid and Satisfied yet as to twelve pounds Eleven Shillings and Seven pence residue of the
af.d fifteen pounds tenn Shillings the Said James Lindow his promisse and assumption af.d in forme af.d made
Nothing regarding but plotting and fraudulently Intending the Said James Edwards in that parte Craftilly
and Subtilly to Deceive & defraud the Said twelve pounds Eleven Shillings & Seven pence to the Said
James Edwards altho the Same to do the Said James Lindow by the Said James Edwards on the af.d
thirtieth day of Septemb.r in the Yeare af.d and often afterwards at Somrset County af.d within the Jur
af.d he was thereunto requested hath not paid or to him for the Same in Any Sort Contented but the Same to
him hitherto to pay or Content hath refused and still doth refuse and deny whereupon the Said James
Edwards saieth he is worse and hath dam^a^ge to the value of twenty five pounds Curr.t money of Maryland
