             November Court  1730         31

          pursuant to an act of assembly of this province in Such Cases made and provided and now in force the following attachmt
       was Issued against the Effects of the afd Humphry Hughs the tenour whereof followeth in these words vizt

       Somerset ss    Charles absolute Lord and proprietary of the provinces of Maryland and Avalon Lord Baron of Baltemore &c
       To the Sherr of Somerset County Greeting we Command you that you attach any the goods Chattells Rights or Creditts of Humphry ^Hughs^
Late of Somerset County planter if they shall be found in your bailywick to the value of two pounds three shillings and six pence
Currant money and three hundred and fifty pounds of tobacco and when you have the same attached or any part thereof the same
in your Custody safe keep so that you have them before Our Justices of Our County Court of Somerset to be held at dividing Creek
the third tuesday of November next then and there to be Condemned according to act of assembly to and for the use of a Certain Robert
Warren Jun.r unless the said Humphry Hughs by himselfe or his attorney shall appear and answer unto the Said Robert Warren
in a plea of trespass upon the Case &c according to Law and that by Good and Lawfull men of your bailywick you make
known unto the person or persons in whose hands you make ye Same attachment that he She or they be & appear before
the Justices of Our County Court to be held as aforesaid to Shew Cause if any he She or they have why the same goods Chattells
rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made
according to act of assembly in Such Case made and provided if to him her or them it Shall Seem mete and how you Shall
execute this writt that you make known unto Our Said Justices at the day and place aforesaid & have you then & there this Writt
Wittness Samuel Hopkins Gent Chiefe Justice of Our Said Court the twenty second day of august in the Sixteenth Year of
Our Dominion &.c  Anno Dom One thousand Seven hundred & thirty

       Att which said third tuesday of November to witt the Seventeenth day of the Same month anno Dom One thousand
seven hundred and thirty being the day of the Return of the Said Writt Cometh the afd Robert Warren by James Shirley his attorney
and the Sherr of Somerset County to whom the foregoeing writt was directed Likewise Cometh & maketh Return thereof to ye
Court here Endorsed viz.t   By vertue of the within writt to me directed I have attached as the Goods and Chattells of the
within Names Humphry Hughs in the hands of the Said Robert Warren to the value of two pounds three Shillings
and Six pence Currant mony and also in the hands of Richard Simpson to the value of three hundred & fifty pds
of tobacco and before Littleton Townsend & John Doe honest and Lawfull men of my bailywick I have made
known unto the Said Rob.t Warren & Richard Simpson that they be & appear at ye time & place within Contained
before ye Justices within mentioned to Shew &.c                           John Purnall sher

       Whereupon the aforesaid Robert Warren by James Shirley his attorney Came here into Court and prays that the afd two
pounds three Shillings and Six pence Curr.t mony so as aforesaid attached as of the Rights and Creditts of the afd Humphry
Hughs may be Condemned in the hands of the Said Robert Warren towards Satisfying unto the aforesaid Robt
Warren the afd two pounds three Shillings & Six pence Curr.t money and all Costs accrewing upon the writt of
attachment afd &c
                                  Therefore it is Considered by the Court here that the afd two pounds three Shillings & Six pence
Currant money so as afd attached be Condemned in the hands of the aforesaid Robert Warren as of the rights and
creditts of the Said Humphry Hughs towards satisfying of the Said Robert Warren the afd Sum of two pounds three
Shillings and Six pence Curr.t mony and also all Costs accrewing upon the writt of attachment afd &c
                                                                                                      & the afd Richard Simpson Gar as afd is disch.d

This being an action of trespass upon the Case &.c  Wherein the Sherr of Somerset County [illegible]
the writt in the Same action was directed Comes & makes Returne Returns thereof to the
Court here Endorsed viz.t  Cepi Corpus P John Purnall sher
                   Thereupon the Said John Burke in his own proper person appears and thereupon the Said John Burke
    at the prayer of the plfts attorney aforesaid is adjudged to Give Speciall Bail to the action afd thereupon a Certain
    John Purnall of Somerset Gent present herein Court undertakes for the Said John Burke that if in Case the Said
