John Stewart and proved the above Acct
According to the form and Directions of
the Act of Assembly in Such Cases provided
before me

        A Copy of the foregoing Declaration and Account were made and sent to be served on
        the Defend.t with the Writt in the plea afs.d &c 
                                                                                 Att which said third Tuesday of March
        to witt the Twentieth day of the Same Month Anno Dom one thousand seven hundred
        and thirty two Came the Said John Stewart by his Attorney afores.d and the Sher of
        Somerset County to whom the aforegoing writt was Directed Likewise Cometh and
        maketh return thereof to the Court here Endorsed in this words following vizt Cepi Corpus
        declaration delivered in time p Joshua Caldwell sher

                                                                Att which day the plea afd with all things thereunto
        Relateing was by act of assembly and the Court adjourned untill next Court to be held at dividing
        Creek the third tuesday of June next &c

                Att which said next Court to witt the Ninteenth day of June anno Dom One thousand seven hundred
and thirty three Came again the afd John Stewart by his attorney afd and the said Mary Porter Executrix
of the Same Hugh Porter by Francis Allen her attorney Comes and defends the force and Injury when &c and
saith that the aforesaid John his Acction aforesd thereupon against her to have and Maintain ought
not because she saith that she hath fully administered all the Goods and Chattles which were of
the aforesaid Hugh at the time of his Death in her hands to be administred and that she hath no
goods or Chattles which were of the aforesaid Hugh at the time of his Death in her hands to
be Adm.rd nor had at the Day of the Impetration of the Original Writt of the aforesaid John
nor at any time Afterwards And this she is ready to verifye    Whereupon she prays Judgm.t
if the aforesaid John his Accon aforesaid thereupon ag.st her to have ought &c
                                                                                                          And Whereupon
afterwards the said Mary by her Attorney afores.d Relinquisheth her Verification afores.d
by her above Alledged and says that she Cannot Gainsay the Acction aforesaid of the afsd
