306 aforesaid within the Jurr of this Court Did Riotuously and Unlawfull Assemble and Gather together and being so then and there Assembled and Gother'd together In and upon a Certain Francis Porter in the peace of the said Lord propy then and there being with force and Arms an Assault did make and him the Said Francis then and there did beat wound and Evilly Entreat so that of his Life it was Greatly Dispared and Other harms to the Same Francis then and there did offer to the Grevious Damage of the Same Francis and against the peace of the Said Right Hon.rble the Lord prop.ry his good Rule and Goverment as also against the form of the statute in that Case made and provid'd whereupon the aforesaid Rob.t Jenkins Henry Gent prays advisement of the Court in the premises and that Due process may Issue against the aforesaid William Beavans Elias Beavans Samuel Baker and Samuel Turner afs.d Thereupon Command is Given to the Sherr of Somersett County that Immediately he should take the said William Beavins Elias Beavins Samuel Baker and Saml Turner if &c so that he might have them here in Court to answer &c And afterwards to witt the Same twenty first Day of June Anno Dom one thousand seven hundred and thirty three before his Lordships Justices of the County Court of Somerset now Sitting at Dividing Creek in the Same County Came the aforesaid Wm Beavans Elias Beavans and Samuel Baker severaly In their Proper Persons and had a hearing of the Information afores.d and thereupon they all seperatly say that they are not thereof Guilty and of this they Severally putt themselves upon the Country and the aforesaid Robt Jenkins Henry Attorney for his Said Lordship ^who for his said Lordship^ in that part followeth Likewise &c Whereupon the Said William Beavans Elias Beavans and Samuel Baker Severally Relinquisheth their Verrification aforesaid by them severally above Alledged and all Severally say that they will not Content with his said Lordship the Lord prop.ry but Submitt themselves with a Protestation of their Innocency and put themselves upon the favour of the Court &c Whereupon all and singular the premises by the Court here seen heard & fully understood Therefore it is Considered by the Court here that the said William Beavans Elias Beavans and Samuel Baker be taken to satisfye his Lordship of their fines by Occasion of the Trespass and Riott aforesaid which Certain W.m Beavans Elias Beavans and Samuel Baker then and there present here in Court aforesaid prays themselves to be admitted at fine with her Said Lordship by Occasion aforesaid and thereof they Severally put themselves in Mercy of his Said Lordship And thereupon the fine of the said W.m Beavans by the Justices aforesaid is assessed to one ^hundred^ pounds of tob.o and the fine of the Same Elias Beavans is assessed by the same Justices to be fifty pounds of Tob.o and the fine of the same Samuel Baker is by the Same Justices assessed to fifty pounds of Tob.o to the use of his Said Lordship his heirs and Successors &c thereupon the sher to Witt Joshua Caldwell Gent present |
