owes and Unjustly Detaines &c And Whereupon the same Charles by Francis Allen his Attorney saith that the said Charles at a Court held for Northumberland County in Virginia of the Eighteenth Day of June one thousand seven hundred and thirty one before the Worshipfull his Maj.ties Justices of the said Court by the Consideration of the same Court Recovered against the said W.m as well the sum of five Pounds Eleven shillings and four pence Current Money of Virginia as also the sum of two thousand one hundred and Nine pounds of tobacco as by the Record and Proceedings in the said Court Remaining more plainly appears to be paid unto the said Charles when he should be thereunto Required Nevertheless the said Will.m tho' often Required the said five pounds Eleven Shillings and four pence Current money of Virginia and two thousand one hundred and Nine pounds of tobacco to the said Charles hath not Rendered but the same to him hitherto to Render hath Denyed and still Doth Deny and Unjustly Detain to the Damage of the said Charles of ten pounds Current money of maryland and four thousand pounds of tobacco and thereupon he brings suit with this that the said Charles will Verifie that five Pounds Eleven shillings and four pence Current money of Virginia is Equal in Value to Six pounds two shillings and five pence Current Money of Maryland and thereupon he brings Suit &c Pledges &c Jno Doe & R Roe And the aforesaid William Wye in his proper person Comes and defends the force and Injury when &c and says that he Cannot gainsay the action the action aforesaid of the aforesaid Charles Fallin nor but that he Owes the aforesaid Charles the aforesaid Six pounds two shillings and five pence Current Money of Maryland (being of equall Value with the aforesaid five pounds Eleven shillings and four pence Currant money of Vergenia) and two thousand One hundred and nine pounds of tobacco in manner and form as the aforesaid Charles above against him hath declared &c Therefore it is Considered that the aforesaid Charles Fallin Recover against the aforesaid William Wye the afd Six pounds two shillings and Five pence Currant money of Maryland ^of the Value of five pounds Eleven Shillings and four pence Currant money of Vergenia^ and two thousand one hundred & and nine pounds of tobacco his debt aforesaid as also three hundred and tenn pounds of tobacco for his damages which he had by Occasion of the detaining of that same debt to the Same Charles of his assent by the Court here adjudged and the afd William in Mercy &c whereupon the afd Charles by his attorney afd freely here in Court remitteth to the afd Wm Wye the afd three hundred and tenn pounds of tobacco his damages afd therefore the afd W.m of the afd three hundred and tenn pounds of tobacco damages afd be quiett &c
