274 Thereupon the proceeding aforesaid between the parties aforesaid in the plea aforesaid is Continued until the Next Court and the same day is given to the aforesaid parties here also &c Att which said next Court to witt the twenty first day of November anno Dom One thousand Seven hundred and thirty two Came againe as well the aforesaid William Horsey as the aforesaid William Wye by their attorneys afd and thereupon the said William Wye by his attorney aforesaid as before defends the force and Injury when &c and Says that he Cannot Gainsay the action aforesaid of the aforesaid William Horsey nor Can he Say but that he did assume upon himselfe in manner and form as the aforesaid William Horsey above against him hath Complained and as to the damage of the Same William Horsey by him by Occasion of the premisses in that part Sustained the same William Wye saith and Confesseth that the aforesaid William Horsey hath Sustained damages by Occasion of the premisses further than his Costs and Charges by him about his Suit in that part apposed to three pounds five shillings and Nine pence Currant Money and One hundred and Five pounds of tobacco and not more and because the aforesaid William Horsey denys not this but the Same allegation ^Confeseth^ to be true prays Judgm.t and those damages above Confessed together with those Costs and Charges aforesaid to him adjudged &c Therefore by Consent of the parties aforesaid it is Considered that the aforesaid William Horsey recover against the aforesaid William Wye Jun.r his damages aforesaid to the afd three pounds five shillings and Nine pence Currant money and One hundred and five pounds of tobacco by the Same William Wye in form 459 afd Confessed as also four hundred & fifty Nine pounds of tobacco for his Costs and Charges aforesaid to the Same William Horsey at his request by the Court here and Consent of the parties aforesaid adjudged and the afd deft in Mercy &c
should safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of November ^then^ Next to answer unto Thomas Bluett of a plea of trespass upon the Case &c and that thereof he Should not fail &c Att which said third tuesday of November to witt the twenty first day of the Same month anno Dom One thousand seven hundred and thirty two being the day of the return of the Said Writt Came the said Thomas Bluett in his proper person and the Sher of Somerset County to whom the foregoeing writt was directed ^likewise^ Came and made return thereof to the Court here endorsed vizt Cepi Corpus P Joshua Caldwell sher whereupon the said John Crawford by Francis Allen his attorney Comes and defends the force and Injury when &c and the aforesaid Thomas Bluett then and there his writt aforesaid against the aforesaid John Crawford did not prosecute with Effect but Voluntarily permitted his Suit to be discontinued Therefore therefore afterwards (to witt) at the same day and place by discretion of the 148 Justices aforesaid were adjudged the Same John Crawford pounds |
