Justices of his Lordships County Court of Somerset to be held at Dividing Creek
the third tuesday of June then Next to answere unto Gavin Hutchison
of a plea of trespass upon the Case &c   And that thereof he Should not fail &c
Att which Said third third tuesday of June to witt the twentyeth day of
the Same Month Ann Dom one thousand Seven hundred and thirty
two Came the Said Gavin Hutchison by Levin Gale his Attorney and
the Sher of Somerset County to whome the foregoing writt was Directed
Likewise Came and made returne thereof to the Court here Endorsed in
these words following            Cepi Corpus P Jos.a Caldwell sher

And the afd Jno Brittingham by Francis Allen his Attorney Cometh
and Defendeth the force and Injury when &c and prays Leave thereof
to Imparle here untill the Next Court and he hath it and the Same
day is given to the afd Gavin Hutchison here also &c       Att which
said Next Court to witt the fifteenth day of August Ann Dom one thousand
Seven hundred and thirty two Came againe the afd Jno Brittingham by
his Attorney afd and ofer's himselfe against the Said Gavin Hutchison
in the plea afd but the Said Gavin altho Solemnly Called Came not
nor further prosecutes his writt afd      Therefore it is Considered that
the afd Gavin Hutchison and his pledges of prosecuting be in Mercy
and that the plft Name pledges &c and that the afd John Brittingham
go thereof without Day   Also it is Considered that the afd John Brittingham
Recover against the afd Gavin Hutchison his Damages by
193   Occasion of the Premises to One hundred & Ninty three      pounds
of tobacco to the Same John by Discretion of the Justices here at his
^request for his^ Costs and Charges by him about his Defence according to the form of
the Statute in such Case made and provided adjudged &c

Command was given to the sher of Somerset County that he should take Charles
Ramsey Late of Somerset County planter if he should be found in his bailywick
and him should safe keep so that he might have his body before the Justices of his
Lordships County Court of Somerset to be held at dividing Creek the third tuesday of of June then
next to answer unto Gavin Hutchison of a plea of trespass upon the Case &c and that thereof he
should not fail &c
                                           Att which said third tuesday of June to witt the twentieth day of the Same
month anno Dom one thousand seven hundred and thirty two being the day of the return of the Said
