       August Court            1730                 23

And whereupon the same plft prays that the aforesaid deft to his declaration afd may answer but the same deft altho Solemnly
Called Came not nor says nothing in barr or preclusion of the action aforesaid of the afd plft by which the Same
plft Remaineth against the afd Deft thereof undefended &c

            Wherefore the afd Charles his damages by Occasion of the premisses against the aforesaid Jones Ought to Recover but
because it is unknown what damages the aforesaid Charles sustained by Occasion of the premises   Command is Given
to the Sher of Somerset County that by the Oath of Honest and Lawfull ^men^ of the County aforesaid he diligently Inquire what
damages the afd Charles hath Sustained as well by Occasion of the promise and assumption aforesaid as for his Costs and
Charges by him about his Suit in that part apposed and the Inquisition of which thereof he takes to this Lordships Justices of
the County Court of Somerset to be held at dividing Creek the third tuesday of November Next under his Seal and
the Seal of them by whose Oath the Same Inquisition he takes he send together with his Lordships writt thereof to him
directed and the same day is Given to the afd plft here also &c






                                        The Court Adjourns untill the third Tuesday of November ann.o Dom 1730
