One thousand Seven hundred and thirty two at somerset County aforesaid in and upon a Certain Mary Foley in the peace of God and the aforesaid Lord proprietary then and there being an assault made and her beat wounded and evilly Entreated so that of her Life it was Greatly despaired and other Enormityes to her the said Mary and against the peace of the right honrble the Lord proprietary &c thereupon Command was Given to the sher of Somerset County that he should take ye Said Heber Whittingham if &c to answer &c and afterwards (to witt) this fifteenth day of august anno Dom One thousand Seven hundred and thirty two Came hereinto Court the aforesaid Heber Whittingham in his proper person and hath a hearing of the Information afd and being Instantly demanded how he would acquitt himselfe of the premisses aforesaid above upon him Imposed says that of the premisses aforesaid above upon him Imposed he is Guilty thereof and the premisses in the Information afd Expressly Confesseth whereupon all and Singular the premisses by the Court here seen heard and fully understood It is Considered by the Court here that the aforesaid Heber Whittingham pay to his said Lordship the Lord proprietary for his fine for and by Occasion of the trespass and assault afd whereof in form aforesaid he is Convict one hundred pounds of tob.o and that the Said Heber Whittngham be taken to Satisfie his said Lordship of the fine aforesaid Whereupon the Said Heber Whittingham is Committed into the Custody of the sher of Somerset County thereto remain untill the fine afd is Satisfied and the severall Officers Fees due by occasion of the premisses Joshua Caldwell sher present herein Court took Charge of the Said Heber Whittingham accordingly &c
in the County aforesaid and within the Jurisdiction of this Court did Committ fornication with a Certain Ann Maycomb of the County aforesaid Spinster and on the body of the Said Ann then and there did begett a bastard Child to the high displeasure of Almighty God and to the Evill Example of all Others in Such Cases Offending and against the form of the acts of assembly in Such Cases made and provided wherefore the Same Thomas Bluett prays ye advise of the Court in the premisses and that due process of Law thereon against the Said Patrick Stuart to Issue Thereupon Command was Given to the sher of Somerset County that he should take the Said Patrick Steward if to answer &c and afterwards here (to witt) the fifteenth day of august anno Dom One |
