210 parties aforesaid it is Considered that the afd John Owterbridge recover against the aforesaid Nathaniel Horsey his damages afd to the aforesaid Nine pounds twelve shillings and Seven pence Curr money by him in form afd Confessed as alsoe 615 Six hundred and Fifteen pounds of tobacco for his Costs and Charges aforesaid to the Same John at his request by the Court here and Consent of the parties aforesaid adjudged and the afd deft in Mercy &c
March ^then^ Next to answer unto Tirrill Brown of a plea of trespass upon the Case &c and that thereof he should not fail Att which Said third tuesday of March to witt the twenty first day of the same month anno Dom One thousand Seven hundred and thirty One being the day of the return of the Said Writt Cometh the Said Tirrill Brown by Thomas Bluett his attorney and the sher of Somerset County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed viz.t Cepi Corporn p Joshua Caldwell sher And the Said Boaz Walston and Mary his wife by George Dashiell their attorney Cometh and defendeth the force and Injury when &c and whereupon the dispute in this action is by the Court and Consent of the parties aforesaid referred (to Robert King and Thomas Williams Gentm) according to the form of the statute in Such Case made and provided and their award to be returned to Next Court that the Justices may proceed thereon to Judgm.t and ye Same day is Given to the plft and defts aforesaid &c Att which Said next Court (to witt) the twentieth day of June anno Dom One thousand Seven hundred and thirty two Came againe as well the afd Tirill Brown as the afd Boaz Walston and Mary his wife by their attorneys aforesaid and Likewise the afd Robert King and Thomas WIlliams the Gent mentioned in the aforesaid rule of referrence and made return of their award in the premisses as followeth viz.t Bee it known to all Concerned that on the 17th day of June Ann D.o 1732 we the Subscribers met at M.r David Willson to Execute a Comission of Auditt hereunto Annext at w.ch time & place were present Terrill Brown Pleft.t and Boaz Walston and Mary his wife Deft and after Due Examination of what Each party had to say Relating to their dispute do report as followeth It did then appear to us by John Browns will that the aforesd Tirell was Left to the Care of John Fountain now Dec.d untill he Should arive at full age of twenty one years before which time the Said Fountain dec.d and further itt appears to us that Mary afd then widdow of said fountain now wife to Boaz Walston Caused the aforementioned Terrill Brown to appear at Court in a few Months after the death of her husband fountain to have the Courts Dircetion therein and the Said Brown was by the Court ordered to the |
