County within the Jurisdiction of this Court was Indebted unto the said Betty in two pounds thirteen shillings and Nine pence Currant mony of Maryland for sundry goods wares and Merchantdizes by the said Betty to the said Finch before that time sold and delivered as present hereunto annexed and here in Court produced may appear and being so thereof thereof Indebted the said Finch in Consideration thereof the day and year afd in the County afd within the afd Jurisdiction upon himselfe did assume and to the said Betty then and there did faithfully promise that he the said Finch the said two pounds thirteen shillings and nine pence to the said Betty when he should be thereunto requested he would well and faithfully pay and Content Nevertheless the said Finch his promise and assumption afd made nothing regarding but plotting and fraudulently Intending the said Betty in that part Craftilly and Subtilly to deceive and defraud the afd two pounds thirteen shillings and nine pence to the same Betty hath not paid altho' the Same to do the said Finch by the said Betty was Often thereunto requested or her for the same in any wise Contented but the same to her to pay or in any sort to Content hath altogether refused and still doth refuse and deny to the damage of the said Betty of five pounds seven shillings and Six pence Curr.t mony and thereof brings Suite &.c L Gale P Quer Pledges &.c Jno Doe R Roe
And the said Finch Jones being Called appears and thereupon the said Finch Jones at the prayer of the Plft attorney is adjudged to give Speciall bail to the action afd thereupon a Certain Robert Harris of Somerset County planter present herein Court and undertakes for the said finch Jones that if in Case the said Betty Gale shall Recover Judgmt in the plea afd against the afd finch Jones or that the said Finch should be therein Convict that then he the said Finch shall pay the Condemnation of the Court or render his body to the Custody of the Sherr of Somerset County in Satisfaction thereof or that he ye said Robert Harris will do it for him &c Whereupon the said Finch JOnes in his Own proper person comes and Defends the force and Injury when &c and says that he Cannot Gainsay the action aforesaid of the afd Betty nor Can he say but that he did assume upon himselfe in manner and form as the afd Betty above against him hath Complained and as to the damage of the same Betty by her by occasion of the premisses in that part Sustained the same Finch says and Confesseth that the afd Betty hath Sustained damages by Occasion of the premisses in further then her Costs and Charges by her about her Suit in that part apposed to two pounds thirteen shillings and nine pence Currant mony and not more and because the afd Betty deny's not this but the Same Allegation Confesseth to be true prays Judgm.t and those damages above Confessed together with her Costs and Charges afd to her adjudged &.c Therefore by Consent of the parties afd it is Considered that the aforesaid Betty Gale Recover against the aforesaid Finch Jones her damages afd to the aforesaid two pounds thirteen shillings and Nine pence Currant mony by the same 242 Finch in form afd Confessed as also Two hundred and forty two pounds of tobacco for her Costs and Charges afd to ye Same Betty at her request by the Court here and Consent of the partyes afd adjudged which Certain damages in the whole do amount to two pounds thirteen shillings and nine pence and pounds of tobacco and ye afd deft in Mercy &c |
