202 and Chattells of the said Thomas Richardson which the Said plft doth not Gainsay Whereupon the Said Samuel Hopkins by his attorney aforesaid prays that the aforesaid Goods and Chattells (of the Value of four pounds Sixteen shillings) so as aforesaid Confessed by the Said Nathaniel Crapper may be Condemned in his hands for the Use of the Said Samuel Hopkins towards satisfying unto him his damages and Costs which is to him ^is^ Granted he Giving Security according to act of assembly in Such Case made and provided Whereupon the aforesaid Francis Allen present herein Court undertakes for the Said Samuel Hopkins that in Case the Said Thomas Richardson shall at any time hereafter within a year and a day appear and make ^all or^ any part of the Said samuel Hopkins shall make restitution unto the Said Thomas Richardson of all or such part thereof as shall be so made appear to be undue or that he the Said Francis Allen shall do the Same for him Therefore it is Considered by the Justices here that the aforesaid Ovill Table, One Chest, one rugg and pair of Blanketts, one frying pan, one ax, one Grubbing hoe, one Linnen wheel and bed Stead (all of the Value of four pounds Sixteen shillings Curr.t money) so as aforesaid Confessed be Condemned in the hands of the Said Nathaniel Crapper as of the Goods and Chattells of the said Thomas Richardson towards Satisfying unto the said Samuel Hopkins his damages and all Costs accrewing by means of the attachment aforesaid and that the afd Samuel Hopkins have thereof his Execution &c memorand.m the afd Gar Nathaniel Crapper voluntarily takes his Oath that he hath noe more of the Effects of the said defts in his hands than what he has Confessed &c
to him he owes and Unjustly Detains &c And Whereupon the said Thomas by Francis Allen his Attorney saith that whereas the Said Will.m the wenty first day of November anno Seventeen hundred and twenty Seven at the County of Somerset aforesd within the Jur of this Court by his Certain Writing obligatory w.ch the Said Thomas with the Seal of the Said W.m signed here into Court brings the date whereof is the same day and year did Accknowledge himself to be bound unto the Said Tho.s in the aforesd two thousand Eight hundred Seventy two pounds of Tobacco and Casque to be paid unto the Said Thomas when he should be thereunto required Yett the said William tho' often required the Said two thousand Eight hundred Seven and two pounds of Tobacco and Casque to the Said Thomas hath not rendred but the Same to him hitherto to render hath Denyed and Still doth Deny and unjustly Detain to the Damage of the Said Thomas of two thousand five hundred pounds of Tobacco And thereupon he brings Suit &c Whereupon the said William Hearn at the prayer of the aforesaid Thomas Layfeild is adjudged to |
