198 Allen his attorney and the Sher of Somerset County to whome the foregoing Writt was Directed Likewise Comes and makes returne thereof to the Court here Endorsed Vizt By vertue of the within writt to me Directed to the Justices within Mentioned I Certifie that upon the sixteenth day of May one thousand seven hundred and thirty two I attached as the goods and Chattells of the within Named Theophilus Dennis in the hands of Christop.r Banks fifteen Bushells of Indian Corn and further Certifie that by John Dennis Jun and Littleton Towensand honest and Lawfull men &c I made known unto the Said Christopher Banks that he be and appear at the time and place within Contained to shew &c as by the within Recept I am Comanded so answere Joshua Caldwell sher Whereupon the aforesaid Saul Townsend by his attorney aforesaid prays the Court that upon Giving Security according to act of assembly in Such Case provide that the afd fifteen Bushells of Indian Corn (of the value of three hundred pence) so as aforesaid attached may be Condemned in the hands of the aforesaid Christop.r Banks as of the rights and Creditts of the aforesaid Theophilus Dennis which is to him Granted &c whereupon the said Christopher Banks altho soe forewarned at the Same day being Solemnly Called Came not but makes default &c Whereupon John Dennis Jun.r of Somerset County Gent present here in Court in his proper person undertakes for the Said Saul Townsend that in Case the Said Theophilus Dennis shall at any time hereafter within a year and a day appear and make all or any part of the Said Saul Townsends claim against him to be satisfied or Otherwise undue before the Laying of the attachment aforesaid that then the Said Saul Townsand shall make restitution unto the Said Theophilus Dennis of all or Such part thereof as shall be made appear to be undue &c or that he ye Said John Dennis will doe the Same for him &c Therefore it is Considered by the Justices here that the afd fifteen Bushells of Indian Corn (of the value of three hundred pence) so as aforesaid attached be Condemned in the hands of the aforesaid Christop.r Banks as of the rights and Credits of the afd Theophilus Dennis towards Satisfying unto the afd Saul Townsend as well One hundred pounds of tobacco as also all Costs accrewing upon the writt of attachment aforesaid and that the Said Saul Townsend have thereof his Execution against the aforesaid Christop.r Banks according to act of assembly &c
Aprill the 18.th 1732 Came before me the Subscriber Adam Spence Sen.r and made oath on the holy Evangelist of Almighty God that the above Account is Just and true to the best of his knowledge and beleaf as it is Stated above Sworn before me Jams Martin Somerset ss It being made appear to me the Subscriber one of his Lordships Justices |
