194 Whittington Runing the Divisionall Line between the Said Fasitt and Evans they run thro' the Said Fasitts old field and the Said Fasitt forewarned him further Saith Not Also Richard Bedward an Evidence for the Comp.t aged about forty five and being Sworn on the holy Evangelist of Almighty God Saith that Cap.t Fasitt said at Nicholas Warrens house that the Land that he held he had bought of William Tomkins and that above bottle bridge there was two marked Hiccorys and Cap.t Fasitt Said that the upermost of the two was his Bound.r and further saith Not the abovesaid Rooten hicory Lies Close to a new Markt red oak Saplin with four Notches and three Notches Standing on the desent of the Said Ridge toward the County Road aforesaid Also the Same day Came Rich.d Hudson Sen.r an Evidence for the Deft aged about fifty four and ^being^ also Sworn on the holy Evangelist of Almighty God Saith that he once bought the abovesd Land of Old Edward Evans and the Said Evans told him that the Corner tree Stood to the Eastward of the County Road being a hicory and that the Second Bound.r a white oak the Said Evans told him Stood by a Savana And further Saith Not Ed Round Jam.s Round
Gale Esq.r prosecutor of his Lordships pleas and Clerk of Indictments and Gave the Same Court to understand and be Informed that John Webb Late of the Same County planter the tenth day of december in the Year of Our Lord One thousand Seven hundred and thirty in the County aforesaid and within the Jurisdiction of this Court did Committ fornication with a Certain Mary Pointer of the County aforesaid spinster and on the body of the Said Mary he there did begett a bastard Child to the high displeasure of Almighty God and to the evill Example of all others in Such Cases offending and against the form of the act of assembly in Such Cases made and provided wherefore the Same Levin Gale prays advise in the premisses and due process of Law thereon against the Said John Webb to Issue now here at this day to witt the twenty Second day of march Ann Dom One thousand seven hundred and thirty one at dividing Creek in Somerset County before his Lordships ^Justices^ in Court Came the Said John Webb in his proper person and hath a hearing of the Information aforesad and Says that he is not Guilty thereof and of this he putts himselfe upon the Country and |
