181 puts himselfe upon the Country and the aforesaid plft in like manner Whereupon the aforesaid Henry altho' Solemnly Called Cometh not nor is his declaration further prosecuted against the same George &c Therefore it is Considered that the aforesaid Henry Fitzwaters and his pledges of prosecuting to witt John Doe and Richard Roe be thereof in mercy and that the aforesaid George Maglamory goe thereof without day &c and further it is Considered that the aforesaid George Recover against the aforesaid Henry his damages by Occasion of the premisses to one hundred & three 103 pounds of tobacco to the Same GEorge by discretion of the Justices here at his request for his Costs & charges in that part Sustained according to the form of the statute &c by the Court here adjudged &c
of Somerset to be held at dividing Creek the third tuesday of Novem next to answer unto Comfort Burton Ann Burton Sarah Prittyman and Patience Waples Executors of the Last Will and testament of Robert Burton late of Sussex County dec.d of a plea that he render unto them the Sum of forty three pounds four Shillings and three pence halfe penny Curr Silver money of america which from them he unjustly detaineth &c and that thereof he should not fail &c Att which said third tuesday of November to witt the Sixteenth day of the Same month One thousand Seven hundred and thirty One being the day of the Return of the Said Writt Cometh the Said Executors by their attorney aforesaid and the Sher of Somerset County to whom the foregoing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following viz.t Cepi Corpus P Joshua Caldwell sher And the said Richard Holland by William Beckingham his attorney Cometh and defendeth the force and Injury when &c and prays Leave thereof to Imparle here untill the next Court and he hath it and the Same day is Given to the aforesaid Executors here also &c Att which said next Court to witt the twenty first day of march ann.o Dom one thousand seven hundred and thirty One Came againe as well the aforesaid Richard Holland by his attorney aforesaid and offers himselfe against the aforesaid Comfort Ann Sarah and Patience in the plea afd but the afd plfts altho Solemnly Called Cometh not nor prosecutes their writt aforesaid Therefore it is Considered that the afd Comfort Burton and Ann Burton Sarah Prittiman and Patience Weples Executors as afd take nothing by their writt aforesaid but that they and ^their^ pledges of prosecuting be in mercy &c and the plfts ^name^ pledges &c and that the Said Richard go thereof without day &c
