17 or any thing that may Relate to the Cause afd and that reduceing the Severall Depositions into writing you said the same together with this Our Commission under your or any three or two of your hands to us to Our County Court of Somerset with all Convenient Speed Wittness William Planner Gent One of Our Justices of Our County Court of Somerset the twewentieth day of March in the fifteenth year of Our Dominion &c On the Back side of the foregoeing Commission it was thus Endorsed viz.t Francis Allen & William Lane Qualified 10.th aprill 1730 before me Jno Scott Somerset County ss Depositions of Wittnesses taken upon the Land Called Mitchells Adventure in the County aforesaid the day of May anno Dom One thousand Seven hundred and thirty before us the Subscribers Commissioners appointed by the worshipfull the Justices of Somerset County Court to Examine Wittnesses Concerning the bounds of the Said Land as followeth vizt Randall Mitchell of Somersett County planter aged sixty Nine Years or thereabouts being by us sworn upon the holy evangelist of Almighty God deposeth and saith that about forty Eight Years agoe he was present with Coll Francis Jenckins the then Surveyor of Somerset County when he Surveyed the abovenamed tract of Land Called Mitchells Adventure at the request of Coll William Stevens who Owned the said Land and that at that time Coll Jenckins Ordered the white Oake now in his view to be marked on four sides as the Last Bounder of the said Land which was done accordingly which said White Oak stands near the South Side of the upper Road Leading from Marumsco Dams to Pocomoke and further saith not his Randall R M Mitchell marke Edward Beachamp of the said County planter aged forty Six Years or thereabouts being also by us sworn upon the holy Evangelist of Allmighty God deposeth and saith that the abovesaid White Oak now in his view was Shown by to him by Mr John Heath in his Lifetime severall times who then always told him that the said tree was the Corner bounded tree of the Land Called Ledbourn then belonging to the said Heath but now in the possession of him the said Edward Beachamp and Edward Hill and further Saith not Edward Beauchamp The above depositions were taken by us the Subscribers being first duly qualified according to Law the day and Year abovesaid as wittness Our hands Francis Allen W.m Lane
of you to be Our Commissioners to Examine Evidences on behalfe of a Certain William Smith of the County aforesaid in relation to the bounds of a tract of Land Lying in the County aforesaid Called Hertlebury we therefore require you or any three or two of you at some time and place as to you or any three or two of you shall Seem Convenient you mete on the aforesaid Land Called Hartlebury (you first having taken your Oath on the holy Evangelist of almighty God according to act of assembly in Such Case made & provided) and there Caus to Come before you or any three or two of you all Such Evidences as shall be to you or any three or two of you nominated by the said Complainant (or defend.t if any) and that you Examine them upon their Corporall Oaths to be by you or any three or two of you administred on the holy Evangelist of Almighty in the presence of the said Complainant (or defend.t if any) touching the truth or Remembrances of their knowledge or any thing that may relate to the Cause afd and that reduceing the severall depositions into writing you send the same together with this Our Commission under your or any three or two of your hands to us to Our County Court of Somerset with all Convenient Speed Wittness William Planner Gent.m One of Our Justices of Our said Court the twentieth day of March in the fifteenth Year of Our Dominion &c On the backside of the foregoeing Commission it was Endorsed and to the Same Commission it was Annexed as Followes Memorand.m that this 2.d of May 1730 Came Capt John Jones one of the within Commissioners before me the Subscriber |
