 Somerset County ss    John Magan Late of Somerset County Schoolmaster
was attached to answere unto John Dennis Jun of a plea of
trespass upon the Case &c
       And thereupon the Said John Magan the first day of October Ann Dom seventeen
       hundred and thirty at Somerset County afd within the Jur of this Court was
       Indebted unto the Said John Dennis Jun in fifteen hundred and Nine
       Pounds of Tobacco and thirteen pounds tenn Shillings and Six pence Currant
       money of maryland as by account hereto annexed may in Court appear and
       being so thereof Indebted the Said John Magan in Consideration thereof the day and
       year afd at Somerset County afd within the Jur afd upon himself did assume and to the
       Said John Dennis then and there did faithfully promise that ^he^ the Said John Magan
       the Said fifteen hundred Sixty Nine pounds of Tobacco and thirteen pounds ten shill
       and Six pence to the Said John Dennis when he should be thereunto requested he
       would well and faithfully pay and Content    Nevertheless the Said John Magon his
       Promise and assumption afd in forme afd made nothin regarding but Plotting and
       fraudulently Intending the Said John Dennis in that part Craftilly and Subtilly to
       Deceive and Defraud the afd fifteen hundred Sixty Nine pounds of Tobacco and thirteen
       pounds tenn Shillings and Six pence to the Said John Dennis altho the Same to do
       the Said John Magan by the afd John Dennis on the afd first day of october in the year
       afd and often afterwards at Somrset County afd within the Jur afd he was thereunto
       requested hath not paid or to him for the Same in any Sort Contented but the Same to
       him hitherto to pay or in any sort to Content hath refused and Still doth refuse and
       Deny whereupon he saith he is worse and hath Damage to the Value of twenty pounds
       Currant money and three thousand pounds of Tobacco and thereupon he brings Suit &c

       And the aforesaid John Magan by William Beckingham his attorney Cometh and defendeth the force and
       Injury when &c and prayed Leave thereof to Imparle here untill the next Court to be held at dividing
       Creek in somerset County the third tuesday of Augt next and he had it and the same day is given to
       the aforesaid John Dennis there also &c

             Att which said next Court to witt the seventeenth day of August ann Dom One thousand seven hundred
       and thirty One Came againe as well the aforesaid John Dennis as the aforesaid John Magan by their
       attorneys aforesaid and whereupon the same John Magan prays further Leave thereof to Imparle hereuntill
       the Next Court and he hath it and the Same day is Given to the afd John Dennis here also &c

       Att which said next Court to witt the sixteenth day of November One thousand Seven hundred and thirty
       One Came againe as well the aforesaid John Dennis as the aforesaid John Magan by their attorneys aforesaid
       and whereupon the said John Magan prays further Leave ^thereof^ to Imparle hereuntill the next Court & he
       hath it and the Same day is Given to the aforesaid John Dennis here also &c

       Att which said next Court to witt the twenty first day of march One thousand Seven hundred and thirty
       One Came againe as well the aforesaid John Dennis as the aforesaid John Magan by their attorney
