Joyner otherwise Called Walter Jacobs was Sumoned to answere
unto Betty Gale assignee According to the forme of the
Act of Assembly in Such Case provided (of George Gale) of a plea
that he render unto her fifty Six bushells of Corne which to her he owes and unjustly detaines &c

And Whereupon the Said Betty by Levin Gale her Attorney saith that whereas the
Said Walter the first day of June Anno Dom one thousand Seven hundred and
thirty at Somrset County within the Jur of this Court by his Certain Writing obligatory
which the Said Betty with the Seal of the Said Walter Signed herein Court brings
the date whereof is the Same day and year afd did acknowledge himself to be bound
unto the afd George Gale in the afd fifty Six bushells of Corn to be paid unto the
Said George when he Should be thereto required which the Said George Gale on
the first day of June one thousand Seven hundred and thirty one at Somrset
County afd within the Jur of this Court did assign unto the afd Betty Gale all his
Right title and Interst to the Said obligation the Condition of the said obligation
then remaining unperformed of which said assignment the Said Walter
Jacobs on the tenth day of August and Year Last Mentioned at Somerset County
afd within the afd Jur by the hands of the afd Betty had Notice by reason whereof
as also by force and Vertue of an act of assembly of this Province now in force
in Such Case made and provided to the Said Walter became Lyable to pay unto
the afd Betty Gale the afd fifty Six bushells of Corn yett the Said Walter tho' often
required the said fifty Six bushells of Corn ^to^ of the Said Betty hath not rendered
but the Same to her hitherto to render hath Denyed and Still doth deny and
Unjustly Detain to the Damage of the Said Betty of one hundred bushells of
Corn and thereupon she brings Suit &c     L Gale P Qrte pledgs         J Doe
                                                                                                         R Roe

And the afd Walter Jacobs in his own proper person Cometh and Defendeth the
force and Injury when and Saith that he Cannot Gainsay the action afd of the
afd Betty Gale nor Can he say but that the writing obligatory afd is his Deed nor but
that he owes the Same Betty the afd fifty Six bushells of Corn in manner and
forme as the afd Betty above against him hath Declared

    Therefore it is Considered that the afd Betty Gale recover against the afd Walter
Jacobs her Debt afd and her Damages by occasion of the Detaining of the Same
218   Debt to two hundred and fifty Eight                              pounds of Tobacco to
218   the Same Betty of her assent by the Court here adjudged and the afd Walter in
Mercy &c
