173 of the afd John Finch by his attorney afd is adjudged to give Speciall bail to the action aforesd Thereupon a Certain Richard Knight of Somerset County Planter ^Present^ here in Court in his own proper person undertakes for the Said John Magan that if in Case the Said John Finch Shall recover Judgment in the Plea afd against the Said John Magan or that the Said John Magan shall be therein Convict that then he the said John Magan Shall pay the Condemnation of the Court thereupon or render his body in Execution to the Sher of Somerset County or that he ^the^ Said Richard Knight will do the same for him &c And afterwards the Said John Magan by Will.m Beckingham his attorney Comes and Defends the force and Injury when &c and Says that he Cannot Gainsay the action afd of the afd John Finch nor Can he say but that the said John Magan did assume upon himselfe in manner and forme as the afd John Finch above against him Complained and as to the damage of the said John Finch by him by occasion of the Premises in that part Sustained the Same John Magan Saith and Confesseth that the afd John FInch has Sustained Damages by occasion of the Premises beyo^u^nd his Costs and Charges by him about his Suit in that part apposed to five hundred ^& fifty^ pounds of Pork and no more and because the afd John Finch denys not this but the Same Allegation Confesseth to be true prays Judgment and those Damages above Confessed together with his Costs and Charges afd to him adjudged &c Therefore by Consent of the Parties aforesd it is Considered that the afd John Finch recover against the afd John Magan his Damages afd to the afd five hundred and fifty Pounds of Pork by the Same John Magan in forme aforesd Confessed as also 265 Two hundred & Sixty Five pounds of Tobacco for his Costs and Charges afd to the Same John Finch at his request by the Court here and Consent of the Parties afd adjudged which Certain Damages in the whole do amount to five hundred and fifty pounds of pork and pounds of Tobacco and the aforesd Deft
of Maryland which to him he Oweth and Unjustly &c And whereupon the same John Rider by William Beckingham his attorney Saith that whereas the aforesaid ^Ignatius^ the Sixteenth day of august anno Dom One thousand seven hundred and thirty One at Somerset County aforesaid within the Jurisdiction of this Court by a Certain Writing Obligatory Granted himselfe held and firmly bound unto the aforesaid John Rider in the aforesd sum of thirteen pounds two shillings and Eight pence Currant money of Maryland to be paid unto the said John Rider when thereof afterwards he Should be Required yett the afd Ignatius |
