that the afd John Finch has Sustained damages by Occasion of the premisses beyound his Costs and Charges by him
about his Suit in that part apposed to three hundred and fifty pounds of Pork and no more and because the afd
John Finch denyes not this but the Same allegation Confesseth to be true prays Judgment and those damages
above Confessed togeth^er^ with their ^his^ Costs and Charges aforesaid to him adjudged &c

                Therefore by Consent of the parties aforesaid it is Considered that the aforesaid John Magan Finch Recover
265   against the aforesaid John Magan his damages aforesaid to the aforesaid three hundred and fifty pounds
of pork by the Same John Magan in form aforesaid Confessed as also two hundred & sixty five
pounds of tobacco for his Costs and Charges aforesaid to the Same John Finch at his Request by the Court here
and Consent of the parties aforesaid adjudged which Certain damages in the whole do amount to three hundred
and fifty pounds of pork and                                                                        pounds of tob.o & ye afd defendt
in mercy &c

 Somerset County ss  John Magan Late of Somerset County Schoolmaster was
Attached to answere unto John Finch of a plea of trespass upon the Case &c
And Whereupon the Said John Finch by Francis Allen his attorney
Complains that whereas the Said John Magan the Ninth day of June
    Seventeen hundred and thirty one at Somerset County within the Jurisdction of this
    Court was Indebted unto the Said John Finch in Five hundred and fifty pounds of good
    Merchantable Pork as by note by the Said John Magan Signed dated the day and
    year aforesd may in Court appear and being so thereof Indebted the Said John
    Magan in Consideration thereof the day and Year aforesd at the Place aforesd within
    the Jur afd in and by the Note afd upon himself did assume and to the Said John
    Finch then and there did faithfully promise that he the Said John Magan the Said
    Five hundred and fifty pounds of good Merchantable Pork at or upon the Last day
    of November then Next Ensuing to be brought to Cap.t John Tunstalls Landing      
    he would well and faithfully pay and Content Nevertheless the Said John Magan
    his promise and assumption afd in forme afd made Nothing regarding but plotting
    and fraudulently Intending the Said John Finch in that part Craftilly and Subtilly
    to Deceive and Defraud the Said five hundred and fifty pounds of Pork upon the
    afd Last day of November to the said John Finch at the Place afd hath not paid altho
    the Same to do the said John Magan by the Said John Finch on the afd Last day
    of November in the year aforesd and often afterwards at Somerset County afd within
    the Jur afd he was thereunto requested but the SAme to him hitherto to pay hath
    refused and Still doth refuse and Deny to the Damage of the Said John Finch of
    Nine pounds Curr.t money of maryland and thereupon he brings Suit &c
