171 Part apposed to three pounds Six Shillings and ten pence and no more and because the afd Susannah denys not this but the Same Allegation Confesseth that to be true prays Judgment and those damages above Confessed together with her Costs and Charges afd to her adjudged &c Therefore by Consent of the Parties afd it is Considered that the afd Susannah Wordie Recover against the afd Isaac Wheeler her Damages afd to the aforesd three pounds Six Shillings and tenn pence ^Currancy^ by the Same Isaac in forme afd Confessed 208 as also two hundred & Eight pounds of Tobacco for her Costs and Charges afd to the Same Susaannah at her request by the Court here and Consent of the Parties afd adjudged which Certain Damages in the whole do amount to three pounds Six shillings & ten pence & pounds of Tobacco and the afd Isaac in Mercy &c
tenour of which Said Bill Follows in these words To the Justices of the County Court of Somerset ss David French Gent by Thomas Bluett his attorney Complaines of James Shirly One of the attorneys of the said Court here present herein Court in his proper person Otherways Called James Shirley of Lewis Gent for that he the Said James unjustly Detaines and doth not render to the Said David twelve pounds Currant money of the Countys on Delaware which to him he owes for that to witt that when the Said James the Eleventh day of May in the Year of our Lord God one thousands Seven hundred and twenty Eight at Lewes Town in the County of Sussex upon Delaware Viz.t at Somerset County afd and within the Jur of this court by his Certain writing obligatory Sealed with his Seal Acknowledged himself to be Indebted and bound to the Said David in the Said Sum of twelve pounds to be paid to the Said David when afterwards he Should be thereunto requested the said twelve pounds to the said David hath not yet rendred or paid but the same to him to render or pay hath hitherto refused and Yett Doth refuse whence he says he is worse and hath Damage to the Value of tenn pounds and thereupon he Seeks remedy &c And offers here in Court the aforesd Writing which Testifyes the debt aforesd in forme aforesd whose date is the day and year aforesaid &c Pledg do p Jn Doe R Roe Tho.s Bluett p Quer And the aforesaid James Shirley In his own proper person Cometh and defendeth the force and Injury when &c and saith that he Cannot Gainsay ^the action aforesaid^ of the afd David French nor Can he Say but that the Writing Obligatory afd is his deed nor but that he Owes the Same David the aforesd twelve pounds in manner and form as the aforesaid David above against the afd Shirly his debt aforesaid and his damages Occasioned by the detention of |
